I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />FEDERAL OMNIBUS TRANSPORTATION <br />EMPLOYEE TESTING ACT <br />POST-ACCIDENT TESTING PROCEDURE <br /> <br />Accident - (1) Except as provided in paragraph (2) of this definition, an occurrence <br />involving a commercial motor vehicle operating on a public road which results in: (a) a <br />fatality, Co) bodily injury to a person who, as a result of the injury, immediately receives <br />medical treatment away from the scene of the accident, (c) one or more motor vehicles <br />incurring disabling damage as a result of the accident, requiring the vehicle to be <br />transported away from the scene by a tow truck or other vehicle. (2) The term accident <br />does not include: (a) an occurrence involving only boarding and alighting from a <br />stationary motor vehicle, or (b) an occurrence involving only the loading or unloading of <br />cargo, or (c) an occurrence in the course of the operation of a passenger car or a <br />multipurpose passenger vehicle (as defined in 571.3 of this title) by a motor carrier and is <br />not transporting passengers for hire or hazardous materials of a type and quantity that <br />require the motor vehicle to be marked or placarded in accordance with 177.823 of this <br />title. <br /> <br />If a City driver is involved in an accident while driving a Class A or Class B City <br />vehicle, the driver must report for alcohol testing within two hours of the accident <br />and controlled substance testing within thirty-two hours of the accident under the <br />following circumstances: <br /> <br />A. If the accident involved the loss of human life, or <br /> <br />Bo <br /> <br />If the City driver received a citation and there was either serious bodily <br />injury needing immediate medical treatment or one or more vehicles must <br />be towed as a result of the accident. <br /> <br />Drivers should immediately notify local police, their supervisor and, if <br />needed emergency medical personnel of the accident. The driver shall then be <br />taken to Coon Rapids Medical Center at 9055 Spring Brook Drive, Coon Rapids <br />as soon as practicable for both alcohol and controlled substance testing. After <br />hours, the driver should be taken to Mercy Hospital at 4050 Coon Rapids <br />Boulevard, Coon Rapids. <br /> <br />A driver who is subject to post-accident testing shall remain readily available for <br />such testing or may be deemed by the City to have refused to submit to testing. <br /> <br />Alcohol Testing. The driver shall report for alcohol testing to Coon Rapids <br />Medical Center within two hours following the accident. The City shall prepare <br />and maintain on file a record stating the reasons that the test was not administered. <br />If the driver does not report for testing within eight hours following the accident, <br />the City shall cease attempts to administer the test and shall prepare and maintain <br /> <br /> 18 <br /> <br /> <br />
