I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Case #5: <br /> <br />Adopt Ordinance to Amend City Code Regarding Construction <br />Work Hours <br /> <br />Zoning Administrator Frolik reminded Council that the ordinance they introduced amending <br />City Code to change the permitted construction work hours from 6:00 a.m. to 10:00 p.m. <br />to 7:00 a.m. to 10:00 p.m. is now being presented for formal adoption. The ordinance also <br />contains language to allow the City Administrator or his/her designee to grant permission <br />for 6:00 a.m. start times under extenuating circumstances and also for individual <br />homeowner to work on construction projects on Sundays. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Zimmerman to adopt <br />Ordinance g95-17 to amend City Code regulations for construction work hours. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beahen, Zimmerman, Beyer <br />and Peterson. Voting No: None. <br /> <br />Case #6: Water/Sewer Connection Charges <br /> <br />City Administrator Schroeder stated that at the September 26, 1995 meeting, Council <br />considered award of a petitioned-for sewer/water project in an existing rural subdivision. <br />The project was tabled. Staff proposed consideration of an amendment to the utility <br />connection requirement policy. Council tabled any action to the proposal also. He <br />included the proposed policy with this case. Mr. Schroeder explained that with public <br />improvements such as this one, there are really two separate cost areas charged by the City. <br />The fkst is for the public improvement itself. These costs for an 80-foot urban lot typically <br />average $8,000 to $9,000. The connection charges include SAC/WAC fees of $2,235 and <br />often trunk charges of $1,539/unit. These fees total $3,864 in 1995.. Mr. Schroeder <br />explained there's no difference between water/sewer utilities and street paving such as <br />Bison Street. Some petition for and some petition against a project; the difference would be <br />cost. In the case of Bison Street, there was a split neighborhood of 50% for and 50% <br />against. The paving is now occurring.' Mr. Schroeder reported that earlier he was <br />proposing that, under the sewer and water improvement, a deferment option be afforded to <br />those who did not petition Council in favor of the improvement. He is not recommending <br />that happen now due to the loss of revenue and the fact that alternatives already exist. If the <br />market value increase resulting from the improvement is not realized, the utility customer <br />can already go to court. He suggested that the original proposal continue, that the owner <br />should have a reasonable amount of time prior to hookup. In the case of the well, we are <br />stating that the owner can continue to use ig however, that option does not exist for the <br />septic system. We are stating again that a reasonable amortization of the septic system <br />should occur. We are requesting that City Council amend its existing connection <br />requirement policy by deleting the last two sentences that talk to public improvement <br />assessment itself. This is the most liberal requirement in the neighborhood. Champlin, Elk <br />River and Andover have a two-year requirement. Elk River is the only one who allows <br />their Council to extend that time. <br /> <br />Mayor Hardin suggested the wording in lines 4 and 5 be changed from "shall be" to "may <br />be" and "Mil'be deferred" to "may be deferred". He expressed agreement with the idea of <br />giving the opportunity to some people to amortize out part of their investment. <br /> <br />Councilmember Peterson inquired how the City will determine what type of criteria we will <br />be looking for. <br /> <br />Mayor Hardin felt that we would have some kind of process set up. <br /> <br />City Council/October 24, 1995 <br /> Page 9 of 19 <br /> <br /> <br />
