Goodrich, City Attorney <br /> <br />Background: <br /> <br />At your meefingon January 9, 1996, the City Engineer updated you on the progress of easement <br />acquisition regarding this project. To date, we have acquired six of the fifteen parcels through <br />direct negotiation' and we have commenced one eminent domain action for two parcels. This leaves <br />seven parcels to be acquired. While negotiations continue, we feel that it is prudent to adopt the <br />attached eminent domain resolution with regard to the remaining seven parcels in order that the <br />project proceed o,n schedule. Even though the attached resolution authorizes condemnation, City <br />Staff will continue negotiating with the owners during the initial condemnation proceedings. <br /> <br />Recommendation: <br /> <br />It is my recommendation that City Staff be directed to continue negotiation with the parcel owners, <br />however, when Staff determines that negotiation will no longer be fruitful, that eminent domain be <br />commenced. <br /> <br />Council Action:nUg''Z~er~('~~e <br />Motion to adopt a resolution authorizi nt domain action with regard to certain of the <br />easement parcels !necessary for Improvement Project//95-12. <br /> <br />Reviewed by: <br /> <br />City Administrator <br />City Engineer <br /> <br />CC: 1/23/96 <br />/kas <br /> <br /> <br />
