councilme~er and moved for its adoption: introduced the following resolution RESOLDTION %96-01- RESOLUTION AUTHORI~IN~ ACQUISITION OF PROPERTY FOR DRAINAGE PZII~I~DBEBo W~P~AS, the City has initiated its pUblic Improvement Project 95-12 (t.~e "Improvement Project") which project consists of constructing drainage improvements in a portion of the North Half of the Northeast Quarter of Section 22, Township 32, Range 25 and part of the~Southeast Quarter of the'Southwest Quarter, Section 15, Township 321, Range 25, Anoka county, Minnesota; and WHERE., perpetual drainage easements over, under and across certain real property are required to provide for the construction of the Improv--ment Project and in order to further the public health, safety and convenience of the residents of the City; and w~R~, the City has authority to acquire the easements for the Public Improvement by eminent domain pursuant to Minn. Stat. Chapter 117; and WHEREA~, the City has the right to acquire the easements prior to the filing of an award by the Court appointed commissioners, pursuant to Minn. Stats. §117.011 and §117.042; and NHERE~., certain of the necessary easements have been acquired by the City~through direct negotiation with the respective parcel owners; and WHEREAS, certain additi°nal parcels need to be acquired in order to complete the Improvement Project; and WH~REA~, the City has identified the additional parcels and I the parcel owners as said follows: I I I I I 1 FEE Om~rER Robert J, AmoM & May L.
