CASE <br /> <br />REQUEST TO REZONE CERTAIN PROPERTY FROM INDUSTRIAL <br /> TO R-1 URBAN RESIDENTIAL; CASE OF GOOD VALUE HOMES <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />As you recall, Good Value Homes submitted a request to rezone the proposed plat of Pondview <br />from Industrial to R-1 Urban Residential. The plat consisted of 149 lots on approximately 85 acres <br />located east of:Ram~ey Blvd. and north of Industry Avenue. <br /> <br />On January 10, 1996, the Planning Commission conducted a public hearing and recommended <br />approval of th° rezoning. <br /> <br />On January 23, 1996, the request was submitted to City Council and the ordinance was introduced <br />by a 3 to 2 vote. (Note: adoption of the ordinance would require a 4/5 vote.) Councilmembers <br />Zimmerman and Beyer expressed concern that the rezoning would have an adverse impact on the <br />City's inventory of industrial property. The Councilmembers requested being provided with <br />various items of information. <br /> <br />On February 13, Council was provided with the requested information. At that time, the developer <br />submitted a revision to the proposed rezoning that would reduce the number of residential lots to <br />135 and retain a strip of industrial property adjacent to County Road #56. The Council directed <br />that the revised rezoning configuration be forwarded to the Planning Commission for an additional <br />review. <br /> <br />Observations: <br /> <br />On March 4, 1996, the Planning Commission conducted a public hearing on the revision to the <br />rezoning configuration to retain some industrial zoning adjacent to County Road #56. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />e) <br />f) <br /> <br />Site location map <br />Previous rezoning configuration <br />Present rezoning configuration <br />Resolution g96-01-027 adopting findings of fact relating to the original rezoning <br />configuration for Pondview <br />Resolution for amended findings of fact <br />Proposed ordinance <br /> <br />Notification: <br /> <br />Staff scheduled a public hearing regarding the revision to the rezoning request and persons owning <br />property within 400 feet of the subject property were notified of the hearing. <br /> <br />Recommendation: <br /> <br />The Planning Commission recommends approval of the proposed modification to the rezoning <br />configuration for Pondview. <br /> <br /> <br />
