Two Hundred and Fifty Dollars shall be collected by the CITY with each building permit issued. The amount of Transportation Impact Fee due by the DEVELOPER prior to recording the Plat is Ten Thousand Dollars and no cents ($10,000.00). This amount shall be credited for Transportation Trail construction in accordance with Item #16 of this agreement. In addition, a credit of $10,000 per acre for additional right -of -way dedication ' along T.H. #47 will be credited toward the Transportation Impact Fee due. 18. Tree Preservation and Planting Plan/Landscape Plan. In accordane with City Code and the policy established by the City of Ramsey Park and Recreation Commission on June 10, 1993, the DEVELOPER is required to submit a Landscape Plan for CITY , approval that identifies existing tree growth within the Plat that will be preserved during construction and new plantings. In addition, sodded boulevards are a requirement for each ' lot in the Plat. It is herein agreed that the requirement for a Tree Preseravation and Planting Plan is fulfilled by the one (1) sheet plan prepared by Hakanson Anderson Associates dated February 15, 1996 and by the DEVELOPER as follows: impact in Minnesota a) Minimizing the of construction on trees accordance with Extension Service publication "Protecting Trees From Construction Damage" (Publication #NR -FO- 6135 -S). b) Planting one two-inch diameter tree (or equivalent thereof) of an approved species at the road frontage or in the front yard of each of the lots in the Plat prior to issuance of a Certificate of Occupancy. In the event the weather is not conducive to tree or sod planting at the time of Certificate of Occupancy, the Building Permit holder shall place a cash deposit in the amount of $200.00 for trees and $100.00 for sod in an escrow account with the CITY and upon verification of the planting being deposit be Builder Permit accomplished, said cash shall refunded to the Holder. Failure of the Builder to comply with the planting requirement within a reasonable time frame following a determination by the CITY that weather conditions are conducive to planting shall give the CITY the authority to cause the planting, the cost of which shall be charged to the escrow account and the builder shall not be eligible for a refund of the cash deposit made for this purpose. 19. Tree Disease Prevention and Disposal, The DEVELOPER shall prevent the ' introduction and spread of tree disease into the residual tree populations of the Plat and adjoining properties and reduce the impacts of construction on the residual property of the Plat and adjoining properties.
