Two Hundred and Fifty Dollars shall be collected by the CITY with each building permit <br />issued. The amount of Transportation Impact Fee due by the DEVELOPER prior to <br />recording the Plat is Ten Thousand Dollars and no cents ($10,000.00). This amount shall <br />be credited for Transportation Trail construction in accordance with Item #16 of this <br />agreement. In addition, a credit of $10,000 per acre for additional right -of -way dedication ' <br />along T.H. #47 will be credited toward the Transportation Impact Fee due. <br />18. Tree Preservation and Planting Plan/Landscape Plan. In accordane with City <br />Code and the policy established by the City of Ramsey Park and Recreation Commission <br />on June 10, 1993, the DEVELOPER is required to submit a Landscape Plan for CITY , <br />approval that identifies existing tree growth within the Plat that will be preserved during <br />construction and new plantings. In addition, sodded boulevards are a requirement for each ' <br />lot in the Plat. It is herein agreed that the requirement for a Tree Preseravation and <br />Planting Plan is fulfilled by the one (1) sheet plan prepared by Hakanson Anderson <br />Associates dated February 15, 1996 and by the DEVELOPER as follows: <br />impact in Minnesota <br />a) Minimizing the of construction on trees accordance with <br />Extension Service publication "Protecting Trees From Construction Damage" <br />(Publication #NR -FO- 6135 -S). <br />b) Planting one two-inch diameter tree (or equivalent thereof) of an approved species <br />at the road frontage or in the front yard of each of the lots in the Plat prior to <br />issuance of a Certificate of Occupancy. In the event the weather is not conducive to <br />tree or sod planting at the time of Certificate of Occupancy, the Building Permit <br />holder shall place a cash deposit in the amount of $200.00 for trees and $100.00 for <br />sod in an escrow account with the CITY and upon verification of the planting <br />being deposit be Builder Permit <br />accomplished, said cash shall refunded to the <br />Holder. Failure of the Builder to comply with the planting requirement within a <br />reasonable time frame following a determination by the CITY that weather <br />conditions are conducive to planting shall give the CITY the authority to cause the <br />planting, the cost of which shall be charged to the escrow account and the builder <br />shall not be eligible for a refund of the cash deposit made for this purpose. <br />19. Tree Disease Prevention and Disposal, The DEVELOPER shall prevent the ' <br />introduction and spread of tree disease into the residual tree populations of the Plat and <br />adjoining properties and reduce the impacts of construction on the residual property of the <br />Plat and adjoining properties.
