Voting Yes: Chairperson Deemer, Commissioners Holland, La_Due, Jansen, <br />Terry, and Thom& Voting No: None. Absent: Chairperson Bawden. <br /> <br />Commissioner Deemer inquired whether #9, which refers to licensing, was accurate. <br /> <br />It was noted that the applicant has returned to the public hearing. <br /> <br />Mr. McLafferty confirmed that he is indeed licensed through the State, County and the Volunteers <br />of America (the sponsoring agency). <br /> <br />Commissioner Jansen inquired as to who inspects and judges whether the boys are receiving full <br />time care. <br /> <br />Mr. McLafferty replied "We have Volunteers of America there every week." He added that there <br />are so many agencies that come out for various reasons, they would be quite aware if this were a <br />problem. <br /> <br />Commissioner Jansen inquired how large the home was. <br /> <br />Mr. McLafferty Stated it is close to 5,000 square feet. <br /> <br />Commissioner Holland asked if there were any further plans to expand. <br /> <br />Mr. McLafferty responded, "Not a chance. I would sell the place in a heartbeat if I could." <br /> <br />Commissioner Jansen inquired as to the closest location of a group home similar to the applicant's. <br /> <br />Mr. McLafferty replied there were several in Coon Rapids. <br /> <br />Commissioner Thorud inquired about the concerns regarding the septic system. <br /> <br />Mr. McLafferty replied "My septic tank works fine. The tank's pumped in' the spring and fall. <br />There are two htlge tanks over 100 feet long. If there was a problem, I would be the first to <br />know." He also noted there are three bathrooms in the home. <br /> <br />Commissioner Deemer inquired' as to whether the septic system maintenance procedures of the City <br />are followed. <br /> <br />City Engineer Jankowski reported that th~ County has done the inspections on the septic system in <br />this particular case. · <br /> <br />Commissioner Deemer questioned why the City didn't have jurisdiction over this. <br /> <br />Mr. Jankowski replied that it was probably .due to the size. He believed that because the County <br />had to be involved with the licensing, they have been involved in the inspections. <br /> <br />Referencing #13, Commissioner Holland inquired as to the definition of a "domestic". <br /> <br />Attorney Fitzpatrick stated there is no specific statute that defines "domestic", however, he <br />explained it does address domestic assault. <br /> <br />Mr. McLafferty stated the legal definition of a domestic is any kind of inteffamilial dispute where <br />the law is called in. He explained that any time there is a problem, before it becomes physical, "I <br />would say 99% of the time, I initiate the call.
