Councilmember introduced the following resolution and moved for its adoption: RESOLUTION ~96-05- A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A REQUEST FOR A CONDITIONAL USE PERMIT FOR A GROUP FOSTER HOME. WHEREAS, on February 7, 1995, Patrick J, McLafferty, hereinafter referred to as "Applicant", applied for a Conditional Use Permit for a Group Foster Home on the property generally known as 7321 154th Lane N.W. and legally described as follows: The South 240 feet of the North 480 feet of the West 225 feet of the East 850 feet of the Southeast Quarter of the Northeast Quarter of Section 21, Township 32, Range 25 in Anoka County, Minnesota; said distances being measured parallel with the East and North lines of said Southeast Quarter of the Northeast Quarter;, subject to an easement for road purposes over the South 33 feet thereof; and WHEREAS, on April 25, 1995, the Ramsey City Council adopted Resolution #95- 04-076 declaring Findings of Fact ~0375 and denied the application for a conditional use permit; and WHEREAS, the Applicant appealed the City's denial of the conditional use permit to the District Court; and WHEREAS, the Anoka County District Court, as a result of the Applicant's appeal, ordered the City to conduct a second public hearing and reconsider the request for a conditional use permit specifically using City Code conditional use permit criteria. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIJ.~ OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That on March 15, 1996, the District Court, Anoka County, Minnesota, issued an order directing the City to reconsider the Applicant's application for a conditional use permit and, in arriving at a decision to grant or deny such application, shall make appropriate and detailed findings regarding the basis for its decision as prescribed by Ramsey Zoning Ordinance, Section 9.03.04. That the Applicant appeared before the Planning and Zoning Commission for a second public hearing pursuant to Section 9.03.04 (Conditional Use Permits) of the Ramsey City Code on May 7, 1996. During the public hearing, the Applicant left the Council Chambers while the hearing was in progress, and returned to the Council Chambers prior to public hearing adjournment. The public hearing was properly advertised and the minutes of said public hearing are hereby incorporated as a part of these f'mdings by reference. That the subject property is approximately one acre in size. That the subject property is zoned R-1 Rural Residential and is not served by sanitary sewer and municipal water. I I I I I I, I I I I I
