Motion by Councilmember Peterson and seconded by Councilmember Zimmerman to prepare a <br />document comparing the two possible sewer hook ups and that Council agrees with the concept <br />that at a future date, we may dispose of the three acres and bringing in the utilities from the <br />proposed Brandseth Addition. Staff will continue to update Council. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peterson, Zimmerman and Beyer. <br />Voting No: None. Absent: CouncilmemberBeahen. <br /> <br />Case #8: MPRS Authorization <br /> <br />City Administrator Schroeder reminded Council of the ongoing actions regarding the Minnesota <br />Police Recruitment System and the unfortunate circumstance that Ramsey has been a party to a <br />lawsuit by virtue of the fact that the City has purchased police recruitment services through MPRS. <br />Earlier this month, we received a request from the MPRS attorney to pass a resolution approving <br />the damage and expense allocation proposed by MPRS. Mr. Schroeder summarized the <br />resolution. It appears that Ramsey will be subject to 1.56% of all costs related to the lawsuit due to <br />our population in relationship to the total MPRS population. We have argued that the cost share is <br />more appropriately borne by number of police officers by city or number of officers hired through <br />MPRS. Under the total number of officers, Ramsey's share appears to be about 1.04%. Mr. <br />Schroeder was not certain of Ramsey's share based upon officers hired. He believed that adoption <br />of the resolution will not subject the City to a cost beyond $15,000. It appears that costs will be at <br />least $12,000. He added that no one can provide a good estimate in that MPRS has not received <br />the claim for attorneys fees from the plaintiffs. Mr. Schroeder continued that this is in relationship <br />to the Stark and Fields lawsuit. He added there are no deadlines for adopting the resolution. He <br />felt that there isn't a tot that the City can do about this and that we could end up being sued by <br />MPRS and its member cities if we do not take this action. He recommended adopting the <br />resolution but for Section 2.2 which reads that the allocation proposed by the MPRS is found to be <br />fair and reasonable, and consent thereto is in the best interest of the City. <br /> <br />Mayor Hardin suggested that there should be some of the City's own language inserted in the <br />resolution - language that would make sense for the City of Ramsey. He felt by adopting the <br />resolution, we are agreeing with it. <br /> <br />Attorney Randall inquired if there is a provision for resolution dispute. <br /> <br />Mr. Schroeder wasn't sure and added that this resolution would not have to be adopted tonight and <br />that Council does have the option of proposing a new resolution to the MPRS. <br /> <br />Councitmember Beyer felt the City really does not have a choice in this matter. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Zimmerman to adopt <br />Resolution g96-02-039 approving allocation of damages and authorizing payment thereof. <br /> <br />Motion carried. Voting Yes: Councilmembers Beyer, Zimmerman and Peterson. Voting No: <br />None. Abstain: Mayor Hardin. Absent: CouncilmemberBeahen. <br /> <br />Case ~/9: Trunk Highway #47 Corridor Study Project <br /> <br />City Engineer Jankowski reported that since 1995, the City of Ramsey has been working with <br />SRF Consulting Group, Minnesota Department of Transportation, and the Anoka County <br />Highway Department to prepare an access and corridor study for the segment of Trunk Highway <br />#47 from the Anoka city limits to t67th Avenue. A preliminary draft of the study has been <br />prepared. The study documents the extent of safety problems and roadway deficiencies along the <br />study corridor and recommends improvements to mitigate these problems.
