NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />o <br /> <br />STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES. <br /> <br />City Code Compliance. That the DEVELOPER will develop the Plat in <br />accordance with the City Code, Section 9.50, entitled "Subd.Msion" <br /> <br />Conformance with Plan. The Plat. shall be developed pursuant to the final <br />plat consisting of one (1) sheet, prepared by Pioneer Engineering. <br /> <br />Incort)o.r.lttion of All City Code ReqlJirements. That the recitals above and <br />the provisions of the City Charter, Subdivision Code, Zoning Code and Public <br />Improvement Code of the CITY as amended to date hereof, are incorporated herein <br />by reference. <br /> <br />Stage I. Improvements Require~l. The DEVELOPER agrees to construct the <br />required Stage I Improvements according to the terms and conditions of this <br />contract and in accordance with DEVELOPERS' plans submitted to the CITY. <br />Said plans shall be in general conformance with the Final Grading Plan prepared by <br />Pioneer Engineering, dated May 20, 1996. <br /> <br />Boulevard and Area Restoration. The DEVELOPER shall be responsible <br />for the cost of establishing seed or sod in al/boulevards within thirty (30) days of <br />the completion of the su'eet improvements, and restore ali other areas ckisturbed by <br />the development grading operation. The DEVELOPER shall also be responsible <br />for the cost of cleaning any soil, earth or debris from the wetlands within and <br />adjacent to this Plat resulting from grading performed ha the development of the <br />land. Any silt fencing utilized in the project for erosion and sedimentation control <br />shall be removed within twelve (12) months of the CITY'S acceptance of the <br />Stage I Improvements. <br /> <br />_Requirements after Street Surfacing. After the street surfacing is installed, <br />the DEVELOPERS shall clear any soil, earth, or debris from the streets and from <br />the lots within the Plat resulting from any construction on the Subject Property by <br />the DEVELOPERS or their successors and assigns. <br /> <br />Removal o[ Debris. The DEVELOPER shall be responsible for the removal <br />and proper disposal of all debris, garbage, and fallen trees from the Subject <br />Property. <br /> <br />Stage 1 !.m..provements . Completion Date. The Improvement completion <br />date shall be on or before September 15, 1996. <br /> <br />St~q~e 1 Imprqvcmenl:. Financial Guarantee. The DEVELOPER agrees <br />and understands that the CITY has the right, privilege and authority pursuant to <br />Minnesota Statutes Chapter 462.358 and as amended as a condition precedent to the <br />approval of the plans and specifications and approval of a final plat, to prescribe <br />requirements and the extent to which, and the manner in which the streets are to be <br />graded or improved, the installation of other facilities, and the removal of debris <br />and that the DEVELOPER shall provide a f'mancial guarantee to the CITY to <br />provide for the actual construction, installation of the required Stage I <br />Improvements, and removal of debris within a period speckfied by the City Council. <br /> <br /> I <br /> I <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I: <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> <br />
