No occupancy permit shall <br />be issued for any lot in the plat until: (a) vehicular access to the permitted lot is <br />provided including the installation of Class V material on all sweets in the Plat; and <br />(b) ali utilities affecting said permitted lot are in place, operational and accepted by <br />the CITY. <br /> <br />Furthermore, during the installation and for a period of 12 months following <br />acceptance by the CITY, any damage to the Improvements shall be repaired at the <br />cost of the DEVELOPER if the CITY is unable to otherwise identify the source <br />of the damage. <br /> <br /> IV. <br />PARK DEDICATION: <br /> <br />Park Dedication. The Plat is located in the Oak Park District. Park dedication <br />shall be satisfied by the DEVFJ.OPER making a cash contribution in the amount of <br />Two Thousand Four Hundred Dollars and no cents ($2,400.00), which represents <br />Six Hundred Dollars ($600.00) for each of the four (4) lots. <br /> <br />GENERAL <br /> <br />Transportation Impact Fees. The CITY has enacted a Transportation Impact <br />Fee in the amount of Five Hundred Dollars ($500.00) per lot. Two Hundred and <br />Fifty Dollars ($250.00) of said fee shall be the responsibility of the DEVELOPER <br />and the remaining Two Hundred and Fifty Dollars ($250.00) shall be collected by <br />the CITY with each building permit issued. The amount of Transportation Impact <br />Fee due by the DEVELOPER prior to recording the Plat is One Thousand <br />Dollars and no cents ($1,000.00). <br /> <br />Tree Preservation and Pla_nting Plan. In accordance with City Code and the <br />policy established by the City of Ramsey Park and Recreation Commission on June <br />10, 1993, the DEVELOPER is required to submit a Landscape Plan for CITY <br />approval that identifies existing tree growth within the Plat that will be removed <br />and/or preserved during construction and new plantings. It is herein agreed that the <br />requirement for a Landscape Plan shall be fulf'flled by the DEVELOPER as <br />follows: <br /> <br />Minimizing the impact of construction on trees in accordance with <br />Minnesota Extension Service publication "Protecting Trees From <br />Construction Damage" (PubLication #NR-FO-6135-S). <br /> <br />Planting one two-inch diameter nee (or equivalent thereof) of an approved <br />species at the road frontage or in the front yard of each of the lots in the Plat <br />prior to issuance of a Certificate of Occupancy. In the event the weather is <br />not conducive to tree or sod planting at the time of Certificate of Occupancy, <br />the Building Permit Holder shall place a cash deposit in the amount of <br />$200.00 for trees in an escrow account with the CITY and upon verification <br />of the planting being accomplished, said cash deposit shall be refunded to <br />the Builder Permit Holder. Failure of the Builder to comply with the <br />planting requirement within a reasonable time frame following a <br />determination by the CITY that weather conditions are conducive to planting <br />shall give the CITY the authority to cause the planting, the cost of which <br />shall be charged to the escrow account and the builder shall not be eligible <br />for a refund of the cash deposit made for this purpose. <br /> <br /> I <br /> I <br /> I <br /> <br /> I <br /> <br />I <br /> <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br /> <br />
