12. <br /> <br />13. <br /> <br />t4. <br /> <br />.I5. <br /> <br />16. <br /> <br />Hard Surfaced Driveways. Hard surfaced driveways are a requirement for each lot <br />in the Plat. Said improvement shall be installed by the building permit applicant or <br />the homeowner at the time the Certificate of Occupancy is issued or as soon <br />thereafter as possible, weather permitting. In the event this improvement is not <br />timely installed, the DEVELOPER, on behalf of all subsequent owners of lots <br />within the Plat, agrees that CITY may install said improvement on any lot and <br />specially assess its cost therefore against the lot. The DEVELOPER hereby waives <br />all fight to a public hearing and other statutory rights or City Charter rights granted <br />a property owner relating to special assessments, including the right to appeal the <br />special assessment for installation of the improvement described in this paragraph. <br />In addition, the DEVELOPER grants the right to the CITY to enter on each lot of <br />the Plat in order to install the improvement described in this paragraph, in the event <br />it is necessary for the CITY to install this improvement and specially assess the <br />salTle. <br /> <br />III. PERMITS AND OCCUPANCY <br /> <br />Requirements for Occupancy Permits. No occupancy permit for any lot in the Plat <br />shall be issued until: (a) vehicular access to the lot is provided including the <br />installation of Class V material on all streets in the Plat; (b) site plan approval is <br />granted by the CITY and any additional expense incurred in giving site plan <br />approval has been reimbursed to the CITY; (c) a Certificate of Survey, including <br />that information required by the CITY, been supplied to the City Building Official; <br />(d) a tree planting has been accomplished in accordance with Item #15 of this <br />Agreement; and (e) ali the financial guarantees required by the CITY have been <br />satisfied. <br /> <br />IV. PARK DEDICATION <br /> <br />Cash Contribution. The Plat is located in the Sunfish Park District. Pursuant to the <br />terms of the Wood Pond Hills development agreement, the DEVELOPER agrees to <br />a cash park dedication requirement in the amount of Six Hundred Dollars and <br />no/cents ($600.00) per lot for a total of Eighteen Thousand Dollars and no/cents <br />($18,000.00. <br /> <br />V. TRANSPORTATION AND LANDSCAPING <br /> <br />Transportation Impact Fee. The CITY has enacted a Transportation Impact Fee in <br />the amount of Five Hundred Dollars ($500.00) per lot. The amount of <br />Transportation Impact Fee due on the Plat is Fifteen Thousand Dollars <br />($15,000.00). The DEVELOPER has the option to either:. (a) Pay the entire <br />amount due prior to the CITY releasting the Plat for recording at the County; or <br />(b) Pay fifty percent of the Transportation Impact Fee ($7,500.00) prior to the <br />CITY releasing the Plat for recording and divert the remaining $7,500.00 due as an <br />additional $250.00 fee on each building permit issued in the Plat, <br /> <br />Tree and Sod Planting Plan. Sodded boulevards are a requirement for each lot in <br />the Plat prior to issuance of a Certificate of Occupancy. In accordance with City <br />Code and the policy established by the City of Ramsey Park and Recreation <br />Commission on June 10, 1993, the DEVELOPER is required to submit a <br />Landscape Plan for CITY approval that identifies existing tree growth within the <br /> <br /> I <br /> I <br /> <br /> I <br /> <br />I <br />I <br /> <br />I <br /> <br /> <br />
