I <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />CASE <br /> <br /> REQU~.ST FOR A CONDITIONAL USE PERMIT TO EXPORT SOILS; <br /> CASE OF EDSON INVESTMENT FAMILY LIMITED PARTNERSHIP <br />By: Zoning Administrator Sylvia Frolik & City Engineer Steve Jankowski <br /> <br />Background: <br /> <br />On May 17, 1996, the City received an application from Blaine Edmundson of Edson <br />Investment Family Limited Partnership to export soils from the plat of Brandseth. <br />Brandseth consists of 22 acres for which Council granted final plat approval for the <br />development of 40 single family urban residential lots. The following items are enclosed <br />for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Applicant's letter of application and attachment <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Notification: <br /> <br />Conditional Use Permits are required to be subjected to public .heatings with all properties <br />within 350 feet being notified of the public hearing. <br /> <br />Observations: <br /> <br />The grading plan submitted for approval with the Brandseth preliminary plat will require <br />exporting approximately 21,000 yards of material from the site. City Code does not <br />require a special permit for grading operations associated with an approved plat, unless the <br />operations inx~olve exporting soils from the site. One haul road access point is proposed <br />onto 153rd Avenue N.W. from Outlot A, Brandseth. The Applicant has indicated that the <br />grading operation could take 12 months to complete. <br /> <br />The Planning Commission conducted a public hearing on June 4 and there were no verbal <br />or written comments submitted by the public. <br /> <br />Recommendation: <br /> <br />The Planning Commission and City Staff recommend approval of the permit <br /> <br />Council Action: - ~l~)r~e~la~ <br />Motion to: [~.A <br />'Adopt Resolution 096-06-~____"/adopting Findings of Fact #(9~ ting to the <br />application from Edson Investment Family Limited Partnership for a conditional use <br />permit to export soils. <br /> <br />-and- <br /> <br /> Motion to: <br /> Approve/de_ny Edson's request for a conditional use permit and adopt Resolution <br /> 4/06-06-:l-q~decl~ng terms of same. <br /> <br />Review Checklist: City Engineer <br />CC: 6/11/96 <br /> <br /> <br />
