Councilmember introduced the following resolution and moved for its adoption: I I I I I I RESOLUTION #96-06- A RESOLUTION ADOPTING FINDING OF FACT # RELATING TO A REQUEST FROM EDSON INVESTMENT LIMITED PARTNERSHIP FOR A CONDITIONAL USE PERMIT TO GRADE AND EXPORTS SOILS WHEREAS, the City of Ramsey received an application from Edson Investznent Limited Parmership for a conditional use permit to grade and export excess soils from the property legally described as follows: BRANDSETH, Anoka County, Minnesota (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RA~,MSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: 6 7. 8. 10. That on June 4, 1996, Edson Investment Limited Partnership, hereinafter referred to as "Applicant", properly applied for a conditional use permit to grade and export excess soils from the plat of Brandseth, which plat received final plat approval from the City Council on March 26, 1996. That the applicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on June 4, 1996, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. That in conjunction with final plat approval on March 26, 1996, the Ramsey City Council approve~i~ the Grading Plan for Brandseth prepared by. Hakanson Anderson Associates, Inc., dated December 20, 1995, subject to the City Staff Review Letter March 19, 1996. That the ,Applicant is proposing to export approximately 21,000 yards of earth material from the Subject Property. That the Applicant has stated that the proposed haul route for incoming and outgoing tracks will be from an access point on 153rd Avenue N.W. from Outlot A, Brandseth. That no fill materials are proposed to be imported to the site. That no blasting will be employed in the grading activity. That the existing drainage patterns will not be substantially altered by the proposed grading plan. That the grading operation will increase the traffic to and from the subject property for a one year time frame. That the proposed use will not be unduly dangerous or otherwise detrimental to persons residing or working in the vicinity of the use or to the public welfare.
