Councilmember introduced the following resolution and moved for its adoption: <br /> RESOLUTION NO. 96-04- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE <br />PERMIT BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF <br />PERMIT TO GRADE AND EXPORT SOILS <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. adopting Findings <br />of Fact # for this use and herein approves the Conditional Use Permit subject to the following <br />conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On. , 1996, a Conditional Use Permit ("CLIP") was issued by the City of Ramsey <br />("City") to Good Value Homes, Inc. ("Permit Holder") for grading operations on the property legally <br />described as follows: <br /> <br />The North Half of the Northwest Quarter of Section 27, Township 32, Range 25, Anoka <br />County, Minnesota, EXCEPT the following described tract: <br /> <br />That part of the Northwest Quarter of the Northwest Quarter of said Section 27 described as <br />follows: Commencing at the Southwest comer thereof; thence north 00 degrees 33 minutes 47 <br />seconds West on the West tine of said Northwest Quarter of the Northwest Quarter for a <br />distance of 418 feet; thence North 89 degrees 26 minutes 44 seconds East and parallel with the <br />South line of said Northwest Quarter of the Northwest Quarter a distance of 209 feeg thence <br />South 00 degrees 33 mutes 47 seconds East and parallel to said West line to the said South <br />line thereof; thence South 89 degrees 26 minutes 44 seconds West on said South line to the <br />point of commencement. Except Parcel No. 8, Anoka County Highway Right-Of-Way Plat <br />No. 16. <br /> <br />Also including that part of the Southeast Quarter of the Northwest Quarter of said Northwest <br />Quarter lying northeasterly of Anoka County Highway Right-of-Way Plat no. 8. <br /> <br />("Subject Property:") <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />This permit shall expire one year from the commencement of operations and the Permit Holder <br />shall be responsible for providing the City with at least 48 hours advance notice of the date of <br />commencement of operations. <br /> <br />All grading operations shall be conducted in accordance with the grading plan dated December <br />15, 1995, prepared by Passe Engineering, Inc. The proposed area to be graded is roughly <br />eighty-five (85) acres in size. Excavation of the entire area shall be permitted. Continuation of <br />grading shall require finished grade areas to be restored with six (6) inches of topsoil, seed and <br />disc anchored mulch. <br /> <br />o <br /> <br />All equipment used for grading and hauling operations shall be maintained and operated in such <br />a manner to minimize noise, dust, and vibrations adversely affecting surrounding properties. <br />All equipment shall be kept in good repair.
