Councilmember introduced the following resolution and moved for its adoption: RESOLUTION NO. 96-04- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT TO GRADE AND EXPORT SOILS WHEREAS, the Ramsey City Council adopted Resolution No. adopting Findings of Fact # for this use and herein approves the Conditional Use Permit subject to the following conditions. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On. , 1996, a Conditional Use Permit ("CLIP") was issued by the City of Ramsey ("City") to Good Value Homes, Inc. ("Permit Holder") for grading operations on the property legally described as follows: The North Half of the Northwest Quarter of Section 27, Township 32, Range 25, Anoka County, Minnesota, EXCEPT the following described tract: That part of the Northwest Quarter of the Northwest Quarter of said Section 27 described as follows: Commencing at the Southwest comer thereof; thence north 00 degrees 33 minutes 47 seconds West on the West tine of said Northwest Quarter of the Northwest Quarter for a distance of 418 feet; thence North 89 degrees 26 minutes 44 seconds East and parallel with the South line of said Northwest Quarter of the Northwest Quarter a distance of 209 feeg thence South 00 degrees 33 mutes 47 seconds East and parallel to said West line to the said South line thereof; thence South 89 degrees 26 minutes 44 seconds West on said South line to the point of commencement. Except Parcel No. 8, Anoka County Highway Right-Of-Way Plat No. 16. Also including that part of the Southeast Quarter of the Northwest Quarter of said Northwest Quarter lying northeasterly of Anoka County Highway Right-of-Way Plat no. 8. ("Subject Property:") This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The conditions of this permit are as follows: This permit shall expire one year from the commencement of operations and the Permit Holder shall be responsible for providing the City with at least 48 hours advance notice of the date of commencement of operations. All grading operations shall be conducted in accordance with the grading plan dated December 15, 1995, prepared by Passe Engineering, Inc. The proposed area to be graded is roughly eighty-five (85) acres in size. Excavation of the entire area shall be permitted. Continuation of grading shall require finished grade areas to be restored with six (6) inches of topsoil, seed and disc anchored mulch. o All equipment used for grading and hauling operations shall be maintained and operated in such a manner to minimize noise, dust, and vibrations adversely affecting surrounding properties.
