(vt3 Councilmember adoption: introduced the following resolution and moved for its RESOLUTION ~96-04- A RESOLUTION ADOPTING FINDINGS OF FACT # A REQUEST FOR A CONDITIONAL USE PERMIT RELATING TO WHEREAS, on April 23, 1991, a conditional use permit was issued by the City of Ramsey to Aluminum Recycling, Inc. (subsequently reassigned to Alloy Recovery Company) to establish and operate an aluminum processing facility on the property generally known as 7060 142nd Avenue N.W. and legally described as Lot 2, Block 1, Gateway North Industrial Park Plat I; and WHEREAS, on February 7, 1996, Alloy Recovery Company submitted an application to the City of Ramsey to enlarge the facility with a 9,000 square foot addition to the operations building. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Applicant appeared before the Planning and Zoning Commission for a public hearing pursuant to Section 9.03.04 of the Ramsey City Code on March 4, 1996, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. 2. That the subject property is approximately 2.5 acres in size. 3. That the subject property is located in the Business Warehouse District. That the adjacent parcels to the north, east and west are zoned Business Warehouse and the adjacent parcels to the south are zoned B-3 Highway Business. That the Applicant is proposing to enlarge the operation with a 9,000 square foot addition to the existing 2, i00 square foot principal building. That the Applicant has submitted a site plan drawn by John Oliver & Associates, Inc. dated February 5, 1996. That by a physical inspection of the subject property on February 20, 1996, Cit') Staff has determined that the Applicant is not in compliance with the current conditional use permit with respect to providing the City with copies of regulatory permits, monitoring reports, shipping manifests, and screening outside storage. That in telephone conversations with Minnesota Pollution Control Agency, City Staff has determined that for a period of time the Applicant was operating without an air quality permit, but is in the process of correcting that situation. That in telephone conversations with the Anoka County Environmental Services, City Staff has determined that the Applicant is operating without a Hazardous Waste Generators License. I I I ! I I !
