Hard surfaced driveways are a requirement for each lot <br />in the Plat. Said improvement shall be installed by the building permit applicant or <br />the homeowner at the time the Certificate of Occupancy is issued or as soon <br />thereafter as possible, weather permitting, In the event this improvement is not <br />timelyinstalled, the DEVELOPER, on behalf of all subsequent owners of lots <br />with~ the Plat, agrees that CITY may install said improvement on any lot and <br />specially assess its cost therefore against the lot. The DEVELOPER hereby <br />waives all fight to a public hearing and other statutory fights or City Charter rights <br />granted a property owner relating to special assessments, including the fight to <br />appeal the special assessment for installation of the improvement described in this <br />paragraph. In addition, the DEVELOPER grants the righ[ to the CITY to enter <br />on each lot of the Plat in order to install the improvement described in this <br />paragraph, in the event it is necessary for the CITY to install this improvement and <br />specially assess the same. <br /> <br />Upgr. a. des to Pre-existing Homestead: It is herein agreed that the DEVELOPER is <br />responsible for upgrading the pre-existing homestead (Lot 7, Block 1) to render it <br />more compatible with the new home development occuring around it. <br /> <br />III. PERMITS AND OCCUPANCY <br /> <br />Requirements for Occupancy Permits. No occupancy permit for any lot in the Plat <br />shall be issued until: (a) vehicular access to the lot is provided including the <br />installation of Class V material on all streets in the Plat; (b) site plan approval is <br />granted by the CITY and any additional expense incurred in giving site plan <br />approval has been reimbursed to the CITY; (c) a Certificate of Survey, including <br />that information required by the CITY, been supplied to the City Building Official; <br />(d) a tree planting has been accomplished in accordance with Item #15 of this <br />Agreement; and (e) all the financial guarantees required by the CITY have been <br />satisfied. <br /> <br />IV. PARK DEDICATION <br /> <br />Park Dedication. The Plat is located in the Sunfish Lake Park District. Park <br />dediCation requirements shall be satisfied by a cash payment. The cash payment <br />due [to the CITY for park dedication is Twenty Thousand Six Hundred Twenty Five <br />Dollars and no cents ($20,625.00). <br /> <br />V. TRANSPORTATION AND LANDSCAPING <br /> <br />Transportation Impact Fee. The CITY has enacted a Transportation Impact Fee in <br />the amount of Five Hundred Dollars ($500.00) per lot. The amount of <br />Transportation Impact Fee due on the Plat is Twelve Thousand Five Hundred <br />Dollars ($12,500.00). These funds are intended to facilitate the contiunation of <br />Sunwood Drive, an east/west collector in .the area. The DEVELOPER has the <br />option to either: (a) Pay the entire amount due prior to the CITY releasting the <br />Plat for recording at the County; or (b) Pay fifty percent of the Transportation <br />Impact Fee ($6,250.00) prior to the CITY releasing the Plat for recording and <br />divert the remaining $6,250.00 due as an additional $250.00 fee on each building <br />permit issued in the Plat. <br /> <br /> <br />
