REQUEST TO REZONE CERTAIN PROPERTY FROM R-1 <br /> RURAL RESIDENTIAL TO R-3 URBAN RESIDENTIAL; <br /> CASE OF NEW LIFE CHURCH <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />New Life ChUrCh has acquired property on the east side of T.H. #47 at about 172nd Lane. <br />They are proposing to build their new church structure on the but it is zoned R-1 <br /> property <br />Rural Residential, for which churches are not a permitted use. Consequently, the City has <br />received formal application for a rezoning of the property to R-3 Urban Residential, for <br />which churches are a permitted use. <br /> <br />The following items are enclosed for your information: <br /> <br /> a) map <br /> Site <br /> location <br /> b) Church concept plan <br /> c) Proposed findings of fact <br /> d) Proposed ordinance <br /> <br />Notification: <br /> <br />State Statute requires notification of the rezoning hearing to persons owning property <br />within 350 feet of the subject property. Staff notified persons owning property within 400 <br />feet of the subject property. " <br /> <br />Observations: <br /> <br />The site is approximately 11 acres in size. The property to the north, south and east is <br />zoned R-1 Rural Residential. The property on the west side of T.H. #47 is zoned Planned <br />Unit Development. Although the R-3 district is generally intended to facilitate development <br />of higher density housing in the urban district, the City Code does contain development <br />standards for K-3 without city sewer and water. <br /> property <br /> <br />The Planning Oommission conducted a public hearing on July 2, 1996 and there was one <br />neighboring property owner present that expressed support for the request. The Planning <br />Commission also noted that there is another church in the single family district within 1/2 <br />mile of this proposed location. <br /> <br />Recommendation: ' <br /> <br />The Planning Commission recommends approval of the proposed rezoning. <br /> <br /> Council Action: <br /> <br /> Motion to' <br /> Adopt Resolution//96-07-~adopting Findings of Fact ~O.__ relating to a/req'i~st~"~ <br /> from New Life Church to rezone certain property from R-1 Rural Residfl. nfial to R-3 <br /> Urban Residential. // <br /> <br />I <br /> <br /> <br />
