I I I I I I I I I I I I I I I I I Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #96-08- RESOLUTION :AUTHORIZING THIRD PARTY PAYMENT FOR WATERMAIN, STORM SEWER, SANITARY,SEWER AND STREETS IN ACCORDANCE WITH PLEDGE AND ;PAYMENT AGREEMENT FOR BRANDSETH ADDITION WHEREAS, the City Council of the City of Ramsey approved the final plat for the Brandseth Addition on March 26, 1996; and WHEREAS, the City Council accepted a "Pledge and Payment Agreement" in lieu of the standard financial guarantee; and WItEREAS, the Pledge and Payment Agreement states that all construction payments must f'zrst be reviowed and accepted by the City prior to authorizing the third party, identified as Registered Abstracters, Inc., to pay down on the funds identified in the Pledge and Payment Agreement; and WHEREAS, the developer has submitted construction bills for the installation of sanitary sewer, watermain, storm sewer and street construction payable to WB Miller, Inc. in the amount of $171,809.24; and WHEREAS, the City Engineer has reviewed said bills and agrees that the construction bill does coincide . with improvements that have been installed in the Brandseth Addition and recommends payment to WB Miller, Inc. in the amount of $171,809.24 by Registered Abstracters, Inc. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City Council hereby authorizes Registered Abstracters, Inc. to pay $171,809.24 to WB Miller, Inc. for the installation of sanitary sewer, watermain, storm sewer and streets in the Brandseth Addition. 2) That the City Council directs the Finance Officer to forward a certified copy of this resolution to Registered Abstracters, Inc. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: and the following abstained: and the following were absent: whereupon said resolution was declared duly passedand adopted by the Ramsey City Council this thel3th day of August, 1996.
