By: <br /> <br /> DEVELOPMENT IMPACT FEES <br />Ryan R. Schroeder, City Administrator <br /> <br />Background: <br /> <br />Council is aware of the recent court decision against the City of Eagan regarding transportation <br />impact fees. Council is also reminded that the City of Ramsey adopted a somewhat similar fee <br />earlier this year. As a result of that, you had asked Attorney Goodrich to research the issue and <br />come back with a recommendation. He has done so by the attached memorandum. <br /> <br />While Attorney Goodrich is concerned that it appears we are in an uncomfortable legal position, we <br />have entered into construction and development contracts assuming some level of revenue from <br />transportation fees against developments benefitted by the roadway or similar infrastructure <br />contemplated prior to the levy of the fee. Therefore, it is the staff position that, prior to any <br />amendment of the existing ordinance, we need to meet with impacted developers in an attempt to <br />work out issues and impacts surrounding the necessity for this fee. While ultimately we may have <br />to amend the existing ordinance to some degree, I believe we can delay that action until after <br />meeting with the development community. <br /> <br />Council Action: <br /> <br />Motion to direct staff to meet with developers impacted by the transportation impact fee and bring <br />back recommendations therefrom to a future Council meeting. <br /> <br />Reviewed by: <br /> <br />City Administrator <br />City Attorney <br />Finance Officer <br /> <br />CC: 08/09/96 <br />/jmt <br /> <br />Copies also distributed to: <br /> <br />City Engineer <br />Zoning Administrator <br /> <br /> <br />
