St. Paul, MN 55075-2469 <br /> <br />Dear Luanne; <br /> <br />I am in receipt of your letter dated July 27, I995, regarding the employment of Diana Lund. <br /> <br />On.April 11, 1995, the Ramsey Council Personnel Committee and City Council authorized posting <br />and advertisin, g the position of Senior Accountant in pay classification 13. Prior to committee <br />action, I stated by way of presentation that "the position is currently exempt" and that I would <br />"request that 'it remain that way". Subsequently, the Committee authorized the position as <br />requested but for a title amendment. This recommendation was made in that for purposes of unit <br />determination under Minnesota Statutes 179 A.03, Subdivision 17, this position I believe has <br />"...authority tO effectively recommend a supervisory function...". I am unsure at this point if 179 <br />A.03, Subdivision 4 also applies. <br /> <br />On May 9, 1995, Council authorized the filling of the position within the posted range at an <br />annualized cost of $34,654, of which $654 would be allocated toward the purchase of vacation. <br />The posted hiring range was $28,893 - $35,383. <br /> <br />We did not inform the AFSCME local of the above in any formal way. The position previously <br />existed. Also, through a prior BMS process, the position had been declared as exempt. Pursuant <br />to the April 1;1, 1995 Personnel Committee discussion, I do not believe it was intended by the <br />Committee or.the Council that this position be other than that. <br /> <br />The position ~of Senior Accountant is currendy listed in City Personnel records as an exempt <br />position. In Order for a change to occur, I believe it would require Council action or action of the <br />Bureau. In either case, if it is deemed that an error occurred, it wouldn't seem appropriate to make <br />an amendment retroactively. <br /> <br />Please let me know how you would like to proceed. <br /> <br />Sincerely, <br /> <br />Ryan R.
