I <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />a)~ <br /> <br />From and after development and the opening of the business to be <br />constructed on Lot 1, Block 1, River/47 Plaza Addition, the Owner of said <br />Lot 1 shall reimburse the Owner of said Lot 3 for one-third (1/3) of the <br />Maintenance Costs on a monthly basis within thirty (30) days after receipt <br />of an invoice from the Owner of Lot 3 for the same; and <br /> <br />b) <br /> <br />From and after development and the opening of the business to be <br />constructed on Lot 2, Block 1, River/47 Plaza Addition, the Owner of said <br />Lot 2 shall reimburse the Owner of said Lot 3 for one-third (1/3) of the <br />Maintenance Costs on a monthly basis within thirty (30) days after receipt <br />of an invoice from the Owner of said Lot 3 for the same. <br /> <br />The Owner of Lot 1, Block 1, Old School House No. 28 Addition, shall oversee <br />coastruction of the roadway in the Easement area located on Lots 1 and 2~ Block 1 <br />Old School House No. 28 Addition and Lot 1 and Lot 1, Block 1 River/47 Plaza, <br />sulS, ject to approval by each of the Declarants of the location of the roadway and <br />spe~ ifications for the roadway, including, but not limited to, providing satisfactory <br />evidence of obtaining all required access permits from the County and State, as well <br />as all other necessary permits and approvals. Said roadway construction shall be <br />completed in a good, workmanlike manner and shall be completed by not later than <br />November 1, 1996, subject to delays beyond the reasonable control of the Owner <br />of Lot 1, Block 1, Old School House No. 28 Addition. The Owner of said Lot 1 <br />shall, at its sole cost and expense, maintain and repair the roadway located upon the <br />Easement area of Lots 1 and 2, Old School House No. 28 Addition, including, but <br />not ?limited to, snow plowing, snow removal, and repair and replace as necessary <br />the 'bituminous surface and curbing ("Maintenance Costs"). The foregoing <br />provisions shall be subject to the following: <br /> <br />a) <br /> <br />The Owner of Lot 2, Block 1, Old School House No. 28 Addition, shall, <br />upon the construction of the roadway upon the easement area of said Lot, <br />reimburse the Owner of Lot 1, Old School House No. 28 Addition, for the <br />reasonable costs and construction of the roadway upon the Easement area of <br />said Lot 2. <br /> <br />Page 3 of 8 <br /> <br /> <br />
