I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Kevin Johnson, Johnson Holdings, Inc. stated that the sewer line and water line will be in and will <br />be running up to [he temporary structure. <br /> <br />Motion by Counoilmember Beahen and seconded by Mayor Hardin to adopt Resolution #96-08- <br />206 adopting Fin ~tings of Fact ~0408, as amended, relating to a request for an interim use permit <br />for a temporary office structure on the property generally known as 14150 St. Francis Boulevard <br />NW. <br /> <br />Motion carried. ¥oting Yes: Mayor Hardin, Councilmembers Beahen and Zimmerman. Voting <br />No: Councilmember Beyer. Absent: Councilmember Peterson. <br /> <br />Motion by Counc~member Beahen and seconded by Mayor Hardin to adopt Resolution approving <br />the issuance of an iinterirn use permit for a temporary structure and declaring terms of same. <br /> <br />Motion failed. 'Voting Yes: Mayor Hardin and Councilmember Beahen. <br />Councilmembers Beyer and Zimmerman. Absent: Councilmember Peterson. <br /> <br />Voting No: <br /> <br />City Attorney Goodrich advised that with adoption of a findings in the positive, it is difficult to <br />legally deny the rektuest for this permit. By September 23, 1996, Council will need to make a <br />decision to approve or deny this. If that time frame (60 days from July 23), the permit will be <br />automatically approved. ..::'.. <br /> <br />Mr. Schroeder inq.uired if this should be brought back on a subsequent Council agenda to which <br />Mayor Hardin stated that it should. <br /> <br />Councilmember Zitnmerman stated he feels the City is giving this one business an unfair advantage <br />and all businesses ¢hould be treated equally. He felt this is not fair to the existing bank across the <br />street. <br /> <br />Councilmember Beyer stated that we have rules in our City Code that spell out processes and by <br />allowing this busin~ess to by-step that is setting a precedence. We have held a lot of businesses feet <br />to the fire and made them follow this process. <br /> <br />Mayor Hardin inquired if we have had any requests like this and added that obviously other City's <br />approve these temporary structures. <br /> <br />Kevin Johnson stated that by approving this request, Ramsey would not be doing anything out of <br />the ordinary and noted other cities and banks that had operated out of a temporary structure. <br /> <br />Councilmember Beyer stated that "we are Ramsey". We have asked other businesses to follow the <br />Code. <br /> <br />Mr. Johnson did not see how the City is deviating from the Code. <br /> <br />Mayor Hardin agre0d~ that other cities grant this and noted that Elk River had a temporary bank <br />structure. <br /> <br />Councilmember Beyer commented that we are not other cities. <br /> <br />Mayor Hardin sugges, ted it is not appropriate to try to micro-manage other businesses. He felt that <br />the Ramsey residents will not be hurt by allowing this bank to start it's business. <br /> <br />Councilmember Beyer reiterated that we have held other "feet to the fire". <br /> <br /> <br />
