Councilmember <br /> <br />moved for the adoption of the following findings of fact: <br /> <br /> RESOLUTION #96-09- <br />A RESOLUTION ADOPTING FINDINGS OF FA'X'-(2T # RELATING TO <br /> A REQUEST FOR A CONDITIONAL USE PERMIT <br /> FOR A PERSONAL COMMUNICATION SERVICE (PCS) TOWER <br /> <br /> WHEREAS, American Portable Telecom (APT), hereinafter referred to as <br />"Applicant", has properly applied for a Conditional Use Permit to construct, install and <br />operate a telecommunications site on the prope ~rty legally described as follows: <br /> <br />Lot 1, Block 1, HY~10 RAMSEY, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED <br />OF THE CITY OF RAMSEY, ANOKA <br />MINNESOTA, as follows: <br /> <br />BY THE CITY COUNCIL <br />COUNTY, STATE OF <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the Ramsey City Code on September 3, 1996 and <br />that said public hearing was properly advertised and that the minutes of said public <br />hearing are hereby incorporated by reference. <br /> <br />That the Subject Property is located in the Industrial District, is approximately <br />4.3 acres in size, and is owned by KRH Land, LLC. <br /> <br />That the Applicant is proposing to lease a 50' x 50' section of the Subject Property <br />(site) to facilitate the development of the tower. <br /> <br />4. That the surrounding parcels are also zoned Industrial. <br /> <br />o <br /> <br />That the Applicant is proposing to place a 165 foot self-supporting lattice <br />telecommunication tower and equipment cabinets on the site, all of which will be <br />encompassed by an 8 foot high chain link fence topped with 3 strands of barbed <br />wire. <br /> <br />That the Applicant has submitted support documents to the application consisting of <br />a letter from A. Keith Dyer, Property Specialist for APT, dated August 12, !996 <br />and a site plan consisting of Sheets T1 (Project Information), A1 (Site Plan), .A2 <br />(Enlarged Plan), A3 (North and South Elevations), and A4 (East and West <br />Elevations), prepared by Fluor Daniel, Inc. and dated August 8, 1996. <br /> <br />That the Applicant has stated that because the PCS uses low power to insure that the <br />signal stays within the designated cell, it will not interfere with neighboring ceils <br />and no ionizing radiation is created. <br /> <br />That the Applicant has stated that the Ramsey ceil site would establish service for <br />the Ramsey area and Hwy. 10 between Anoka and Elk Pdver and other proposed <br />sites cannot provide coverage to the City of Ramsey due to distance and <br />topographic constraints. <br /> <br />9.
