Cash and Land Contribution. The Plat is in the Mississippi Park District. Park <br /> dedicatiod shall be satisfied with land for trail corridor on the east boundary of Outlot A and <br /> a cash coatribution. City Code requires that park dedication shall be based on $4300 per <br /> acre or 5% of fair market value, whichever is greater. Park Dedication for the Plat shall be <br /> $88,150.00 (20.5 acres x $4,300.00 per acre). The cash contribution due shall be credited <br /> in the amount of One Thousand Two Hundred Dollars ($1,200.00) (.12 acres x <br /> $10,000/aCre) for trail corridor. The net cash payment due to the CITY for park dedication <br /> is $86,950.00. <br /> <br /> Vt <br />GENERAL: <br /> <br />15. Construetion Site Maintenance. The DEVELOPER shall adhere to ail City <br /> ordinance~s relating to, but not limited to, dumping of garbage, site development, <br /> construction debris, open burning, etc. <br /> <br />16. Plat Approval Expenses, The DEVELOPER agrees that it will pay to the CITY all <br /> CITY expenses incurred in the approval of the Plat, including, but not limited to <br /> administration expenses, engineering and legal fees. Said expenses shall be paid within <br /> fifteen (15,) days of billing by the CITY and outstanding billings shall be paid prior to <br /> recording Of the Final Plat. Any expenses incurred after recording of the Final Plat shall <br /> also be p~d within said fifteen (15) day billing period. Failure to pay the CITY'S <br /> expenses within the fifteen (15) day billing period will permit the CITY to draw upon any <br /> of the escrows required by this contract for payment. <br /> <br />· 17. Reiml~or$~ment to the City, The DEVELOPER agrees to cooperate with the CITY <br /> f~>r all costs, including engineering and attorney fees, incurred by the CITY in defense or <br /> enforcement of this Agreement, with the exception of any litigation costs in which the <br /> CITY and the DEVELOPER are adverse parties with respect to this Agreement. <br /> <br />18. Executioniof Agreement, The DEVELOPER shall submit to the CITY a tax status <br /> confirmation from the Anoka County Auditor's office. All real property taxes and special <br /> assessments against the subject property shall be in a current status prior to execution of <br /> this Agreement. <br /> <br /> <br />
