Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beyer and Beahen. <br />Voting No: None~ Absent: Councilmember Peterson. <br /> 7 <br /> <br />Case #4: Request for an Interim Use Permit for a Temporary Structure; Case <br /> of ~Johnson Holdings, Inc. <br /> <br />Zoning Administrator Frolik stated that earlier this summer, Johnson Holdings, Inc. received site <br />plan approval to construct and operate a bank on the former public works site. Johnson Holdings <br />has submitted an dpplication for an interim use permit to utilize a 14' x 60' modular office structure <br />at 14150 St. Frar~cis Boulevard NW. The temporary structure would be used by the bank to <br />conduct business ¢vhile the permanent structure is under construction. Ms. Frolik explained that <br />the City has previously granted permits for temporary office structures in the commercial and <br />industrial areas fo, limited periods of time to accommodate the particular needs of the business. <br />The Planning Commission and City staff are recommending approval of the interim use permit. <br /> [0 <br />She noted that Kevm Johnson was present to answer any questions and that a findings of fact is <br />included in the agenda for Council review. <br /> <br />Councilmember Beyer noted number 8 in the findings of fact and inquired when the City has <br />granted a similar request when there was not a current business on the property. <br /> <br />Ms. Frolik responded that the City has issued nine conditional use permits in the last 10 years but <br />all were augmentigg permanent current structures there except for The Links; that temporary <br />structure was for the manager to live in while the construction was taking place. <br /> <br />Councilmember B~yer suggested that number 8 in the findings of fact is not correct, this is actually <br />a different situation. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to delete #8 which <br />reads: "That the City has granted similar permits in the past". <br /> <br />Motion carried: Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beyer and Beahen. <br />Voting No: None.; Absent: Councilmember Peterson. <br /> <br />Councilmember Bayer called attention to the date of August 12 as the deadline to construct and <br />operate a bank. <br /> <br />Ms. Frolik responded that she is not familiar with the exhibit Councilmember Beyer is referring to. <br />City Administrator Schroeder replied that he also does not know the answer to that. <br /> <br />Councilmember Zimmerman noted findings #14 which states that the proposed temporary structure <br />will be adequately served by essential public facilities and services, and asked if that is true. <br /> <br />Ms. Frolik replied that this is what the Planning Commission recommended and determined to be <br />fact. <br /> <br />Councilmember Beyer asked why the bank would go through all this digging, etc. for a temporary <br />structure, they should just go with the permanent. <br /> <br />Mayor Hardin commented that it's a business decision. <br /> <br />Councilmember BeYer suggested that the City has control of public utilities. <br /> <br />Councilmember zimrnerman inquired about restroom facilities. <br /> <br />City Council/August 27, <br /> Page 9 of 17 <br /> <br />1996 <br /> <br />rn- 7 <br /> <br /> <br />
