In accordance with the findings set forth in Section 2 and pursuant to the authority of Minnesota Statutes, Section 462.355 (subd. 4), there is hereby established a m0'ratorium on the construction, erection, placement, reconstruction, enlargement, or exlbansion of towers within the City and on the development and use of property for su~-h purposes. 2. D~g the period of the moratorium, applications for final site and building plan apLb. roval, building permits, and other permits and approvals related to such tower work shatll not be accepted by the City; neither the Planning Commission nor the City Council sh411 consider or grant approval of any application required for such work, and no bui:!.ding permits for such work shall be issued. These restrictions shall not be apl~licable to proposals for tower development that were approved by the City prior to the!effective date of this ordinance. SECTION 4'. APPLICATION. The momtoriuw shall be applicable to property throughout the City. SECTION 5; PENALTIES. Any person, cOrPoration, or other entity that constructs, erects, places, reconstructs, enlarges, or expands a tower in violation of this Ordinance shall be guilty of a misdemeanor and shall be subject to any additionltl legal or equitable remedies available to the City. SECTION 6~ EFFEt~TIVE DATE. This OrdinancO becomes effective 30 (thirty) days after its publication, shall be effective for 90 days from its e/~fective date, and shall expire at that time unless further extended.
