RNOKR CO ENV SER IS:612-323-6150 NOU 19'96 12:i5 No.Oll P.02 County Contract No. WELLHEAD PROTECTION JOINT POWERS AGREEMENT TI-H$ AGREEMENT is made and entered into by and between the cities of Anoka, Blaine, Centerville, Circle Pin~, Coon Rapids, Fridley, Lexington, Line Lakes, Ramsey, and Spring Lake Park 0~orein "Cities"), and the County of Anoka (herein "County), each acting by and through its governing body, pursuant to Minn. Stat. §471.59 providing for the joint exercise of powers. RECITALS: The Cities are now, or will be, required by the Minnesota Department of Health to prepare wellhead protection plans for their community public water supplies and desire to coordinate their effortq to develop wellhead protection plans for their communitle& The Citie..q have determined that it is in their be.qt intere.~t.q to develop a common ground water model that ha.q common elements for their wellhead protection plans including determination of wellhead protection areas around their public water supply wells, and desire to jointly use the services of a consultant for development of portioms of their wellhead protection plato. The Citie,,~ desire to make a joint decision concerning the be,qt method to determine their needs and selection of a groundwater model and agree that it is in their interests that the cost for development of portions of their wellhead protection plans be shared and their respective responsibilities and obligations be defined. The County is committed to enhancing groundwater protection and public health and finds it to be in the County's interest to facilitate the joint efforts of the Cities. NOW TIIEREFORE, in consideration of the mutual agreements contained herein, and in exercise of the powers granted by Minn. Stat, § 471.59, the parties to this Agreement agree as follows: i. PURPOSE 1.1 The Cities and County agree that they have joined together for the purpose &jointly and cooperatively: IlS 1.1.1 1.i.2 1.1.3 1.1.4 developing common wellhead protection plans for the Cities; establishing a joint user group to handle activities related to this agreement; authorizing the County to act as facilitator and as agent contracting for any consultant services or applying for any grants; and allocating costs. TERM This agreement shall be effective January 1, 1997 and sh',dl continue until terminated as provided herein. ANOKA COUNTY MUNICIPAL WELLHEAD PLANNING GROUP The governing body of each of the Citie~q shall appoint one person to serve as a member of the Anoka County Municipal Wellhead Planning Group (herein "Group").
