Defegdants shall comply with a minority race hiring requirement within seven years of <br />the date of this ~order, such that the hiring rate of minority race persons from i979 to November <br />1, 2003 at leasi equals the hiring rate of whites during the same time period. The "hiring rate" <br />shall be defmecj as the numb.? of applicants hired from each group divided by the total number <br />'of applicants fr~m each group. This hiring requirement is a collective obligation of all defendant <br />municipalities ~nd accordingly the appropriate applicant pool shall include the total nm-nber of <br />persons who submit applications to any of the defendant municipalities over the relevant period <br /> [ <br />of time. <br /> <br /> 7. The $~00,000 statutory penalty imposed on the defendants is stayed pending complianc~ <br />with this order, i Failure on the part of any or all defendants to satisfy the obligations of ordering <br />clauses 4, 5 an~[ 6 above shall result in the imposition of a statutory penalty up to $300,000, <br />jointly and sevelally, against such defendant(s) found to be responsible for such failures. Where <br />such responsibility with respect to ordering clause number 6 cannot be practically assessed against <br />less than all defendants, such penalty shall be imposed upon ail defendants, jointly and severally. <br /> <br /> 8. The c~urt will retain jurisdiction over this matter until Ja_riuary 1, 2004 for the purpose <br />of supervising c0~mpliance with the remedial obligations of this order. On each yearly anniversary <br />date of this order, the defendants shall submit to the court a report with detailed documentation, <br />sworn to by the~ person or persons with actual knowledge of the content, as to the following <br />issues' <br /> <br />a.rThe modification and utilization of the ZM Form of the Watson <br />Giaser test, information regarding the procedure established to <br />c~nvert the scores of the modified test, the changes in the Watson <br />Glaser test and its related procedure as required by this order~ a <br />copy of such test(s) used and the analysis of any adverse impact <br />associated with such test and procedure. <br /> <br />b. ~Progress made toward the achievement of the hiring requiremert <br />of i ordering clause 6 above, including data as to the number of <br />m~ority race and white applicants during the relevant time period, <br />tho number of offers extended during that time period and the <br /> r <br />idqntity and race of applicants to whom such offers were extended <br />anti of applicants to whom positions were given. <br /> <br />c. ~$uch information as required by ordering clauses 4--6 above, and <br />'such other information as is relevant to the remedial obligation of <br />thia order as the court requires. <br /> <br /> 9. The requirements contained in this order are the minimal necessary to remedy past <br />discrimination.
