CITY OF RAMSEY <br /> ANOKA COUNTY, MINNESOTA <br />DEVELOPMENT AGREEMENT - MULLER ADDITION <br /> <br />THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, a <br />murficipal corporation of the State of Minnesota (the CITY"), and ROBERT MULLER and <br />MARTHA MULLER, husband and wife, whose address is 22541 Tulip Street, St. Francis, <br />Minnesota ("the DEVELOPER"). <br /> <br />56 <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the DEVELOPERS are the fee owners of property situated in the CITY <br />OF RAMSEY, County of Anoka, State of Minnesota, and legally described as follows: <br /> <br />Lots 1, 2 and 3, Block I, MULER ADDITION, Anoka County, Minnesota <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, on November 26, 1996, pursuant to Resolution g96-11- , the CITY <br />approved the final plat of the Subject Property which plat is known as MULLER ADDITION <br />(the "Plat") contingent on certain requirements, including DEVELOPERS and CITY entering <br />into this agreement; and <br /> <br />WHEREAS, the Plat consists of three (3) lots totalling approximately 6.3 acres; <br /> <br /> WHEREAS, approval of the Final Plat is given pursuant to the City's Subdivision Code <br />Section 9.50.05 (SUM. 1) entitled "Division or Consolidation of Platted Lots" and Section 9.50.05 <br />(Subd. 2) entitled "Division or Consolidation of Unplatted Lots". <br /> <br /> WHEREAS, no expenditure of CITY funds will be made until City Code escrow <br />requirements have been fulffflled by the DEVELOPER. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />IMPROVEMENTS <br /> <br />Access to Lots. Lots 2 and 3 shall retain existing accesses onto 167th Avenue N.W. <br />and Lot 3 shall retain existing access onto 168th Avenue N.W. <br /> <br />Drainage and Utility Easements. The standard drainage and utility easements around <br />the perimeter of each of the three lots and along existing underground utilities shall be <br />dedicated to the CITY on the Final Plat <br /> <br />II. <br />GENERAL <br /> <br />Park Dedication.
