The most significant amendment included in the ordinance <br />required noir-conforming commercial properties to comply with the requirement for paved <br />and curbed idriveways, off-street parking, display and storage areas by January 1, 1997. <br /> <br />In July of ~is year, City Staff attempted to send written notice to all commercial properties <br />reminding ~em of the pending deadline and the procedure for obtaining site plan approval <br />for the imp~vements or an extension to the compliance date. <br /> <br />Observations: <br /> <br />To date, Ciw Staff has received numerous letters and telephone calls from commercial <br />property owners requesting waivers and/or extensions from the requirement due to <br />financial har~!ship, pending expansions, and development agreements entered into with the <br />City that exehapted the curbing requirement. The City Code does not require <br />property owners to go through the site plan review process for installation of site <br />improvements i(,pavement and curbing). However, with the potential for a great deal more <br />pavement in ~e commercial district, it was thought that it would be appropriate for the <br />paving plans t6 be reviewed by the City Engineer for drainage concerns. To force this to <br />happen, the coBe amendment requires a site plan review for new pavement and curbing. <br />The current al~.plication and escrow fee for site plan reviews is $575.00, which is a <br />significant cost~,~tem for property owners to pay before they can spend the money necessary <br />to comply with~City Code. Therefore, City Staff is recommending that the site plan review <br />process and fe~.s be waived for new pavement installation in lieu of the property owners <br />submitting thei~ paving plans to the City Engineer for prior review and approval. <br /> <br />77 <br /> <br /> <br />
