He suggested that the
Economic Devo~iopment Commissioners would be called so they could be in on the discussion
also. Councilmember Peterson stated that we could eliminate smaller signs if we have a big one
for all the businesses in the area.

Motion carrie& Voting Yes: Mayor Hardin, Councilmembers Beahen, Beyer, Peterson and
Zimmerman. Voting No: None.

Case 4V'/: l~equ, est for a Conditional Use Permit for a Personal Communication
~ervme Tower; Case of American Portable Telecom

Zoning Admin~trator Frolik reported that the City has received an application from American
Portable Teleco~n (APT) to construct and operate a personal communication service (PCS) tower
on Lot 1, Blook 1, HY-10 Ramsey. The applicant is proposing to construct a 165 foot self-
supporting lattice tower on a 50' x 50' section of the subject property. The site operations include
a maximum of six 5' x 3' x 3' equipment cabinets placed on a 10' x 20' cement pad. The tower
and cabinets will be encompassed with an 8' high chain link fence topped with three strands of
barbed wire. 'I~h.. e site and access to it will be prepared with a gravel surface. There will be no
personnel stationed at the site. The Planning Commission conducted a public hearing and there
were no verba~ or written comments received. The Commission noted that the proposed
Transportation ,Map in the Comprehensive Plan Amendment aligns the future westerly extension of
County Road//I16 along the north property line of the subject property. The applicant did agree to
relocating their isite 60 feet south of the north property line so as to not impede this future
· transportation improvement.

Councilmember Zimmerman inquired if this tower would be viewed as an eye sore on Highway
4/10. '

City Administrator Schroeder replied that it appears from literature received from the League of
Minnesota Citi~, that the Telecommunications Act of 1996 bars cities from actions that prohibit or
have the effect Of prohibiting provisions for personal wireless services. It is appropriate, however,
for cities to eshblish reasonable performance standards for towers, including amateur radio
towers.

Councilmembe~ Zimmerman inquired about what if the tower fell onto someone else's property.

Chuck Wendallg representing APT, stated that the tower would not fall down - it would collapse
within itself.

Council reviewed the findings of fact.

City

Council/September 24, 1996
