We incur some costs <br />with the City Aitomey and administrative. The Finance Officer has looked at costs and feels this is <br />what is incurred. <br /> <br /> Mr. Croteau stated that in light of the Charter amendment, there's been talk of the shortfall the City <br /> has to deal w~th: If you factor out fiscal, attorney, and administrative costs, and trunk assessment, <br /> etc., that wouldileave this assessment a lot less than the money we have been talking about. That <br /> should be takeniinto consideration. <br /> City Attorney Qoodrich asked Mr. Croteau if it is his position that he has a functional, private <br /> sewer and wate~ system and that he elects to remain on that system? <br /> <br />Mr. Croteau responded yes. <br /> <br />Wayne Olson, ~5830 - 151st Lane NW, Ramsey, noted that letters objecting to the assessment <br />should have aisc/been received from Wayne Olson and Jane Schmidt, and from John and Marilyn <br />Haubrich. <br /> <br />Mr. Jankowski ~cknowledged receipt of such letters. <br /> _r <br />Mr. Olson contigued that they do have working septic systems and wells and they are electing to <br />stay on these syatems. He added that he is speaking for the Haubrich's also. <br /> <br />Jim Green, 5858i- 151st Lane NW, Ramsey, stated he has a few statements to make. The Charter <br />amendment cam~ about in February, 1996. The project for 151st Lane was started in September, <br />1995. It surprises me you can change anything voted on by the Council long before this <br />amendment, cam~ about. This action says it changes. . for. the future, but not for the past. . This <br />project was start0Fl and people I have talked to smd thxs project was fimshed the day the pxpes went <br />into the ground. !This project was already done so the rem~active date is out of line. This project <br />was completed iri November, 1995. You do not have to have blacktopped streets, etc. to have City <br />sewer and water.~ This project was done before January 1, 1996 so that date is wrong and should <br />not be able to ~ used. He added that there were difficulties with this project from day one and <br />commented on problems with the street lighting, etc. This Charter change was done to benefit the <br />three people whc~did not want to pay for this project. They were not necessarily against it. All we <br />did was done in ~ood faith, the Charter change should not affect this project. <br /> <br />Mr. Goodrich s~ted the initial project, 4/95-14, included several items, sewer and water, storm <br />sewer, etc. The e~ntire project included all of these. Certain segments are not for the whole project. <br />The sewer and ~ater was the most costly item but also included was sod, bituminous, curb and <br />gutter, etc. The!project was not considered complete until everything was installed. In my <br />opinion, the projd~ct was not completed until after January 1, 1996. The sod was put down in July, <br />1996, and the fin~.l payment was August, 1996. In interpreting the Charter language, this project <br />qualifies as it wag completed after 1/1/96. Enactment on the Charter by voters says that you have <br />to deal with that. !We are just assessing now, so there is no retroactivity. He stated he is confident <br />in the position he ',ihas taken earlier on this subject· <br /> <br />Sharon Green, 5858 - 151st Lane NW, Ramsey, read from a letter dated October 16, 1995, that <br />anticipated the co/npletion of the project, weather permitting. If the ground had not frozen when k <br />did, that project would have been completed on time. No one can cona'ol the weather· She <br />inquired if not ha~ing to hook up to City services pertains to the Juskiewicz's and Green's also. <br /> <br />Mr. Goodrich understood that the Green's and Juskiewicz's have signed development agreements, <br />therefore, this Ch .~Wter amendment does not apply. <br /> <br />City Council/October 8, 1996 <br /> Page 17 of 26 <br /> <br /> <br />
