I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I

it's indicated th~s would be for an area where Shorewood would not be a direct beneficiary. There
is no traffic impact from this property because it's just across the street. He commented on the
recent court cas.e in the City of Eagan pertaining to a transportation impact fee. He added, so as not
to stall, we would like to recommend on-going discussions with staff on this fee and the legality of
it but to indicat~ our good faith, we would agree to escrow these funds. That would allow the
building permit ito proceed.

City Attomey Goodrich suggested that the City would perhaps be open to the money being
escrowed.

Mayor Hardin ih, quired if Mr. Hilger would consider redesigning the motor home on the roof top.
The building is beautiful and the lettering would identify it.

Councilmember;Beyer stated she likes the roof-top design.

Mr. Hilger stated, they would design the element with staff.

Mayor Hardin stated that it would be considered part of the square footage toward signage.

Mr. Hilger asked what if it was a clock.

Mayor Hardin re'plied he would have to think about that.

Mr. Hilger stated that the recreational vehicle logo may or may not be a sign. The money would be
spent on #83 andiT.H. #10, and that's within distance of the building. Any business would rather
not pay more fee~ then they have to but we are also trying to make ends meet. We are looking at
safety factors. Cbunty Road #83 and Highway #10 will be much safer now. It's a cost of doing
business. ~

Mr. Hilger corr~ented that it's hard "being first". This fee becomes very steep for the small
businessman. Th'e courts opinion appears to be in our favor but I feel we can discuss this.

Mr. Schroeder po,inted out that every business since has Paid the fee.

Mr. Hilger respon, ded that he was not aware of that.

Ms. Frolik asked ~bout Class V.

Mr. Hilger replied that it would be Class V for phase one and curb and concrete in phase two.

Ms. Frolik stated ~hat business is restricted on Class V to which Mr. Hilger stated he understood
that.

Councilmember P~terson stated that he agrees with Mr. Hilger's statement about what if it were a
clock instead of a haotorhome. He suggested that maybe Council should take a closer look at this.

Councilmember B~yer reiterated that she likes it and feels it add beauty to the building and to
Highway #10.

City

Council/October 8, 1996
