I <br /> I <br /> I <br />I <br />I <br />i <br />! <br />I <br />I <br />t <br /> <br />COMMISSION BUSINESS <br /> <br />Case #1: Proposed Ordinance to Amend the R-1 and R-2 Residential Districts to <br /> Establish Churches as Permitted Uses <br /> <br />Zoning Administrator Sylvia Frolik explained that this ordinance was precipitated from New Life <br />Church applying for rezoning from R-1 Rural Residential to R-3 Urban Residential to permit <br />development of their new facility on the site. The City Council expressed concern regarding a Urban <br />parcel in a Rural district. She explained that City Staffmet with the City Attorney and determined <br />the best solution was to allow Churches in R-1 and R-2 zoning. Ms. Frolik added that the Minnesota <br />courts have ruled that religious facilities should not be excluded from any residential district without <br />good cause. <br /> <br />Chairperson Bawd.en asked if the wording in the proposed ordinance is acceptable. Ms. Frolik read <br />the amended wo~ding; "Churches (except that no church will be permitted in a building designed <br />primarily for residontial use without fa'st applying for and obtaining a conditional use permit and that <br />no church structure will be converted to a commercial use following expiration of occupancy and/or <br />conditional use p6rmit without obtaining a conditional use permit for the commercial use)". <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to recommend that City <br />Council adopt the proposed ordinance to establish churches as permitted uses in the R-1 and R-2 <br />residential districts. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, Jensen, <br />LaDue, Terry, and Thorud. Voting No: None. Absent: None. <br /> <br />Case I/2: <br /> <br />Request for Sketch Plan Approval of Business Park 95 3rd Addition; Case of <br />City of Ramsey <br /> <br /> Zoning Administrator Sylvia Frolik explained that the City of Ramsey is in the process of platting two <br />· more lots in Busilaess Park 95 to accommodate the new facilities for Barkela Manufacturing and <br /> Capco. She expl~ned that this is a minor subdivision and Lot 1, Block 1 is 10 feet deficient of the <br /> requirement for 200 feet of frontage on a public road and will be modified accordingly. <br /> <br />Commissioner Thorud asked if the 10 feet would be added from Outlot A. Ms. Frolik replied <br />affirmatively. <br /> <br />Motion by Commissioner Holland and seconded by Commissioner Jensen to recommend that City <br />Council grant sketch plan approval to Business Park 95 3rd Addition. <br /> <br />Motion carried. 'Voting Yes: Chairperson Bawden, Commissioners Holland, Jensen, Deemer, <br />LaDue, Terry, and Thorud. Voting No: None.
