ValUe Homes has submitted a request for variance to the minimum lot size <br />reqmrements for non-riparian lots in the proposed plat of Sunfish Lake Estates. <br /> <br />The following items are enclosed: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Proposed plat <br />Proposed findings of fact <br />Proposed variance <br /> <br />Notification: <br /> <br />In accordarlce with State Statute, Staff notified property owners within 350 feet of the <br />subject property of the request for variance and public hearing. <br /> <br />Observations: <br /> <br />Protected Wetland #2-113, referred to as Grass or Sunfish Lake, is located within the <br />proposed pl~t of Sunfish Lake Estates. Shoreland overlay regulations for a Recreational <br />Development Lake, as Sunfish Lake is classifed, requires minimum lots sizes of 20,000 <br />square feet for riparian lots and 15,000 square feet for non-riparian lots in the sewered <br />area. The proposed plat consists of 25 lots and has been designed such that the ten riparian <br />lots meet th~ 20,000 square foot area requirement. Only four of the fifteen non-riparian <br />lots meet the 15,000 square foot area requirement. <br /> <br />The applicant has stated that the hardship is due in part to the revision to the alignment of <br />Sunwood D~ve. That alignment has been shifted closer to the Good Value property from <br />what was o~ginally planned and thus narrows down the depth of developable land between <br />the road andithe lake. <br /> <br />If the developer were to plat 10 lots at 20,000 square feet and 15 lots at I5,000 square feet, <br />the total area~ absorbed by the 25 lots would be 425,000 square feet. Under the developers <br />proposal, 10'~lots are platted at an average size of 21,756 and 15 are platted at an average <br />s~ze of 13,822 for a total of 224,890 square feeti If granted, the variance will not permit <br />the applicant~ any more lots than if the plat were designed in slrict compliance with the <br />code. <br /> <br />The intent of the regulations are to protect public waters from pollution. As described <br />above, there will be no more homes developed in the area than if the minimum <br />requirements ~ were met on a lot by lot basis. The plat will also be served by municipal <br />sewer and w~tter systems and the existing homestead parcel will also be converted to the <br />municipal syltem. There will also be a storm sewer system developed in the area. <br /> <br /> <br />
