CASE <br /> <br />REQUEST I~OR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE <br />NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL <br /> STRUCTURE; CASE OF WILLIAM SCHRADER <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />City Code stat~s that accessory structures shall not be constructed nearer the front property line <br />than the principal structure. William Schrader is requesting a variance to construct an accessory <br />garage nearer ~he front property line than the principal structure at 16750 Wolverine Circle N.W. <br />The parcel is a~proxlmately 1.3 acres in size and the house is located approximately 150 feet from <br />the front proparty line. They are proposing to construct a garage which will be approximately 98 <br />feet from the front property line. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />)e plan (2 sheets) <br />posed findings of fact <br />Proposed variance <br /> <br />Notifica ti on: <br /> <br />City Code reqdires that requests for variances be subjected to a public hearing. In the opinion of <br />City Staff, onlj the immediately neighbors are impacted by this request for variance and therefore, <br />only the prope!~y owners within the standard 350 foot distance requirement were notified of the <br />hearing. <br /> <br />Observations: <br /> <br />The site plan s~bmitted reflects, and staff inspection confn'ms, that the side and rear yards are <br />consumed by Septic system, well, and sharp declines in topography. The entire is parcel is <br />covered with rr~ture tree growth. <br /> <br />It could be said ~that the applicant created his own hardship when the placed the home 150 feet back <br />from the front ~roperty line. However, the lot is so heavily wooded and the topography is such <br />that the house lbcation is the only reasonable building pad on the entire parcel. <br /> <br />The subject parcel is entitled to 1,664 square feet of garage and accessory building space. The <br />existing garag~ is 768 square feet; the ,proposed garage is 896 square feet; which totals 1,664 <br />square feet. ~here is also a developer s covenants established in Hunters Ridge. It has been <br />verified that the!covenants doe~ not prohibit accessory garages. <br /> <br />Staff Recomrhendation: <br /> <br />City Staff recommends approval of the request for a variance. <br /> <br /> <br />
