Board Member <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />A <br /> <br /> RESOLUTION g96-05- <br />RESOLUTION APPROVING THE ISSUANCE----OF A VARIANCE AND <br /> DECLARING TERMS OF SAME <br /> <br /> WHEREAS, Jacob Barthold has properly applied for a variance from minimum street <br />frontage or lot width requirements in order to construct a dwelling on the property legally described <br />as follows: <br /> <br /> The Sou.thwest Quarter of the Southeast Quarter of Section 14, Township 32, Range 25, <br /> Anoka County, Minnesota. <br /> <br /> ("Subject Property") <br /> <br /> WHERItAS, the Board of Adjustment met on May 7, 1996, conducted the public hearing <br />and adopted findings of fact. <br /> <br /> NOW WHEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA,! as follows: <br /> <br />Based on;:Findings of Fact # ., a variance from minimum street frontage and lot width <br />requirements to construct a dwelling on the Subject Property is hereby granted. <br /> <br />The Subject Property is eligible for building permits for one dwelling unit and related <br />accessory structures in accordance with City Code and no further building permits for <br />addition~ residential structures will be issued until such time as the Subject Property is <br />replatted and developed to a higher density in accordance with City Code. <br /> <br />Only one Private driveway from the Subject Property will be granted access to 157th Lane <br />N.W. Said driveway shall be surfaced with bituminous, concrete or Class 5. The property <br />owner sh~ll also be responsible for increasing the radius of the temporary cul-de-sac at the <br />west term~us of 157th Lane to City standards by the addition of fill and Class 5 to facilitate <br />maneuve~bility of public maintenance vehicles. These improvements are subject to the <br />prior appi'oval of the City Engineer to ensure that they will not cause erosion or an <br />inordinate amount of runoff and sedimentation onto 157th Lane N.W.or adjacent parcels. <br />The imprtvements to the temporary cul-de-sac and the surfacing of the private driveway to <br />at least Class 5 standards shall be complete and accepted by the City Engineer prior to <br />issuance Of a certificate of occupancy for the dwelling. <br /> <br />At such time as the subject property is replatted to a higher density, the residential structure <br />located on[ the Subject Property shall convert its egress to a public road within said plat, at <br />the expense of the property owner. Said road is anticipated to be a easterly extension of <br />157th Lane N.W. or a northerly extension of Potassium Street N.W. In the interim, the <br />property owner agrees to join in an initial petition calling for a feasibility study for the <br />extension of 157th Lane N.W. or Potassium Street N.W., when and if such a petition is <br />presented.i <br /> <br />That the property owner of the Subject Property shall participate in any street maintenance <br />assessments to 157th Lane N.W., the street from which it receives the benefit of public <br />access, until such time as the Subject Property is platted and served by public streets <br />interior to the plat. <br /> <br /> <br />
