CASE <br /> <br />REQUEST FOR A VARIANCE FROM IMPERVIOUS SURFACE AREA <br />RESTRICTIONS; CASE OF L.A.N.D. PROPERTIES <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />L.A.N.D. Pro~ert/es has applied for site plan approval to construct a rem_il center on Lot 1, <br />Block 1, Riverview Estates. The subject property is located in the Critical River Overlay <br />District and as[ such, the impervious surface area, which includes structures and pavement, <br />is restricted tO 30% of the lot area. The site plan reflects an imperv/ous surface area <br />calculation of 77%. <br /> <br />The following:items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Site Plan <br />Proposed findings of fact <br />Proposed variance <br /> <br />Noti fi ca ti on: <br /> <br />In accordance with State Statute, persons owning property within 350 feet of the subject <br />property were notified of the request for variance. Notice of the variance request has been <br />forwarded to the Department of Natural Resources. At the date of this writing, no response <br />comments havre been received from DNR. <br /> <br />Observation:s: <br /> <br />The main purpose of the impervious surface area restriction is to prevent pollution of the <br />Mississippi River from surface water runoff. Although more detail has been requested, the <br />drainage plan[ submitted by the applicant appears to meet the minimum water quality <br />requirements of the Lower Rum River Water Management Organization. An additional <br />purpose of the: development restrictions established in the Critical River Overlay District is <br />to maintain a ~minimum amount of development density in order to preserve the natural <br />aesthetics of ~e river corridor. The subject property is not visible from the river. <br /> <br />The Board approved a similar variance in 1994 for the Dubats Self-Storage facility. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the variance contingent upon DNR certification of <br />same. <br /> <br />Board Action: <br /> <br />Motion to: <br />Adopt :Resolution g96-06- adopting Findings of Fact # relating to <br />L.A.N~D. Properties' request for a variance to impervious surface area restrictions <br />on Lot 1, Block 1, Riverview Estates. <br /> <br />-and- <br /> <br /> <br />
