Absent: Board Member Terry. <br /> <br />PUBLIC ltEAR[NGS <br /> <br />Chairperson Deemer adjourned the regular Board of Adjustment meeting at 7:05 p.m. in order to <br />conduct the following public heating: <br /> <br />1) Request for a Variance to Impervious Surface Restrictions in the Mississippi River Critical <br /> Overlay District; Case ofL. A.N.D. Properties <br /> <br />Chairperson Deomer called the regular Board of Adjustment meeting back to order at 7:30 p.m. <br />BOARD BUSINESS <br /> <br />Case #1: Request for a Variance from Impervious Surface Area Restrictions; Case of <br /> L~A.N.D. Properties <br /> <br />Board Member Holland asked if the detention pond would be kept full or would be dry. Mr. <br />Jankowski stated that the pond would normally be dry and explained that to keep water in it, the pond <br />would either have to be lined with clay or dug down to the water table, which is not feasible in this <br />case. <br /> <br />The Board of Adjustment proceeded to review the Findings of Fact. <br /> <br />Motion by Board Member Bawden and seconded by Board Member Terry to approve the Findings <br />of Facts #1 through #13 as presented. <br /> <br />Motion carded. Voting Yes: Chairperson Deemer, Board Members Bawder~ Terry, Holland, Jensen, <br /> [ <br />LaDue, and Thorud. Voting No: None. <br /> <br />Motion by Board Member Terry and seconded by Board Member Holland to amend #14 to read "is". <br /> <br />Motion carried. Voting Yes: Chairperson Deemer, Board Members Terry, Holland, Bawden, Jensen, <br />LaDue, and Thorad. Voting No: None. <br /> <br />Motion by Board Member Terry and seconded by Board Member Bawden to amend #15 to read "will <br />not". <br /> <br />Motion carried. Voting Yes: Chairperson Deemer, Board Members Terry, Bawden, Holland, Jensen, <br />LaDue, and Thorud.
