Board Member introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #96-09- <br /> <br /> A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FOR A VARIANCE TO CONSTRUCT AN AU-C-gSSORY STRUCTURE <br />NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE <br /> <br /> WHEREAS, David Clampitt, hereinafter referred to as "Applicant", has properly applied <br />for a variance from Section 9.11.02 of the Ramsey City Code to construct an accessory garage <br />nearer the front property line than the principal structure on the property generally known as 16051 <br />Ramsey Blvd. N.W. and legally described as follows: <br /> <br />The north 394.7 feet as measured on the east and west lines of the Northwest Quarter of the <br />Southeast Quarter of Section 15, Township 32, Range 25, except the west 220.75 feet <br />thereof as measured on the north and south lines together with an easement for road <br />purposes over the west 33 feet of the west 220.75 feet of the north 394.7 feet of the <br />Northwest Quarter of the Southeast Quarter of Section 15. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of <br />the Ramsey City Code on September 3, 1996 and that said public hearing was properly <br />advertised and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br /> <br />That the subject property is zoned R-1 Rural Residential and is approximately 4.2 acres in <br />size. <br /> <br />That the subject property is surrounded by R-1 Rural Residential zoning developed with <br />single family homes. <br /> <br />That Section 9.11.02 of the Ramsey City Code does not permit the construction of <br />accessory structures nearer the front property line than the principal structure. <br /> <br />That the principal structure on the subject property is located approximately 483 feet from <br />the front property line. <br /> <br />That the Applicant is proposing to construct an accessory garage approximately 458 feet <br />from the front property line. <br /> <br />That the City of Ramsey previously issued a building permit for another accessory building <br />on the property that is located closer to the front property line than the principal structure. <br /> <br />That there are unique circumstances applying to the subject property that do not generally <br />apply to other properties in the district; namely that the side and rear yards contain mature <br />tree growth, declines in topogrphy, wetlands and drainfields. <br /> <br />That the special condition causing the undue hardship do not result from the actions of the <br />Applicant. <br /> <br />10. <br /> <br />That similar variances have been granted in the R-1 Rural Residential district in the City of <br />Ramsey. <br /> <br />11. That the variance requested is the minimum variance which would alleviate the hardship. <br /> <br /> <br />
