CASE #1: <br /> <br />REQUEST FoR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE <br />NEARI~R THE FRONT PROPERTY LINE THAN THE PRINCIPAL <br /> STR~CTURE; CASE OF JAMES AND MICHELE MYSLICKI <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />City Code states that accessory structures shall not be constructed nearer the front property line <br />than the principa~ structure. James Myslicki is requesting a variance to construct an accessory <br />garage nearer thelfr.o, nt property line than the principal smlcture at 16811 Zirconium Street N.W. <br />The parcel is apprpxlmately 5 acres in size and the house is located approximately 154 feet from the <br />front property lin{. They are proposing to construct a garage which will be approximately 95 feet <br />from the front p~perty line. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) Proposed f'mdings of fact <br />d) Proposed variance <br /> <br />Notification: <br /> <br />In accordance with State statutes, properties within 350 feet of the Myslicki property were notified <br />of the public hearing. <br /> <br />Observations: <br /> <br />The site plan submitted reveals that them are sharp declines in topography in the side and rear yards <br />of the Myslicki pn0perty. There is also mature tree growth and septic system location to consider. <br /> <br />Staff Recommendation: <br /> <br />City Staff recommends approval of the request for a variance. <br /> <br />Board Action: <br /> <br />Motion to: <br />Adopt Resolution #96-10__ adopting Findings of Fact # <br />Msylicki's,,i'equest for a variance. <br /> <br />relating to James and Michele <br /> <br />Motion to: <br />Approve/d~ny the request for a variance from James and Michele Myslicki to construct an <br />accessory Structure nearer the front property line than the principal structure on the property <br />known 16g:l 1 Zirconium Su'eet N.W. and adopt Resolution 4596-10-. declaring terms of <br />variance. <br /> <br />B/A: 11/7/96 <br /> <br /> <br />
