DECLARATION OF COVENANTS, CONDITIONS AND <br />:RESTRICTIONS FOR BUSINESS PARK 95 ADDITION <br /> <br />This Declaration is made as of September 28, 1995, by the City of Ramsey, a Minnesota <br />Municipal corporation (the "Declarant"). <br /> <br /> WHEREAS, Declarant is the owner of real property in the City of Ramsey, Anoka <br />County, Minn6sota, legally described as: <br /> <br /> All of the lots and blocks in the BUSINESS PARK 95 ADDITON, <br /> <br /> and Declarant desires to submit said real property and all improvements on it <br />(collectively called the "Property") to the provisions of this Declaration; and <br /> <br /> WHEREAS, Declarant desires to declare and establish covenants, conditions and <br />restrictions which will benefit and burden the Property for the purpose of facilitating <br />development c~f the Property and for the purpose of protecting and preserving the value and <br />desirability of the Property. <br /> <br /> THEREFORE, Declarant declares that the Property, shall be owned, used, <br />occupied and ~onveyed subject to the covenants, conditions and restrictions set forth in this <br />Declaration, ail of which shall be binding on all Persons owning or acquiring any fight, title <br />or interest in the Property and their heirs, personal representatives, successors and assigns. <br /> <br />SECTION ! <br />DEFINITIONS <br /> <br /> 1.01 "Architectural Review Board" shall mean the board established <br />pursuant to Section 3 of this Declaration (the "Board"). <br /> <br />1.02 "Declarant" shall mean the City of Ramsey <br /> <br /> 1.03 "ilmprovements" shall mean all structures and other construction on a lot <br />or parcel for a~ use permitted by the zoning ordinances of the City of Ramsey, including, <br />but not limited to, buildings, outbuildings, parking areas, loading areas, outside platforms <br />and docks, d~i."veways, walkways, fences, lawns, landscaping, signs, retaining walls, <br />screening wa[Is, decks, railroad tracks, poles, berms and swales, and exterior lighting. <br /> <br /> 1.04 "Lot" shall mean a portion of the Property identified as a lot on a <br />subdivision plgt prepared in accordance with Minnesota Statutes, Chapter 505, and filed for <br />recording in the Anoka County Recorder's Office. <br /> <br />Page 1 of 8 <br /> <br /> <br />
