Scenic River <br /> <br /> § 9.23 <br />2. A copy of all amendments to this Section and final decisions <br /> granting variances or conditional uses within the Shoreland <br /> Overlay District shall be sent to the Commissioner of Natural <br /> Resources within ten days of the amendment or final action. <br />3. A copy of all plats approved within a shoreland overlay district <br /> shall be submitted to the DNR within 10 days of final action. <br /> <br />Nonconforming Sewage Treatment Systems. In the Shoreland Overlay <br />District, all existing sewage treatment systems inconsistent with the <br />standards of §8.3 shall be brought into conformance or discontinued <br />within five years from the date of enactment of this Section. <br /> <br />9.21.05 ~nvironmental permits and standards. <br /> Subdivision 1.Environmental Permit. To insure that the policies in this <br />section are pro .t!erly implemented, any person undertaking development to or on any land within <br />the Shoreland a~d Critical River overlay districts shall, prior to commencing the work, obtain an <br />environmental ~ermit from the City. Except as hereinafter provided in this section, no person shall <br />perform any development in the overlay districts without first having obtained an environmental <br />permit (hereinafter called permit) from the City. Exempted from this env',m3_nmental permit <br />requirement shgll be all lots within a plat of record in the Anoka County Recorder s Office. Outlots <br />contained within.' a plat shall not be exempted from this permit requirement. <br /> <br />Notwithstanding this permit exemption, development occurring on any lot, whether in a plat or <br />not, must comply with and conform to the "Permit Standards" as outlined in the following section. <br /> Subd. 2. Permit Standards. The following standards shall be met when any <br />development is ~ndertaken within the overlay districts. <br /> a. No filling, grading, dredging, excavation or construction shall be <br /> allowed within any wetlands area; nor on lands abutting, adjoining or <br /> affecting said areas if such activity upon those adjacent areas is <br /> incompatible with City policies expressed here, in other documents and <br /> in the relevant storm water drainage study. Development is improper <br /> and therefore prohibited which may result in loss and damage to public <br /> and private improvements through inundation by flood waters and <br /> subsequent expensive construction of storm sewers and other public <br /> projects, in the permanent desu-uction of natural resources, loss of water <br /> retention facilities, open space and wildlife habitats and impairment of <br /> public and private water supplies. Minimum area requirements for <br /> building sites shall be determined in accordance with Section 9.04 of the <br /> City Code, the standards of the Shoreland Overlay District and the <br /> Critical Rivers Area Overlay District. <br /> b. Except in the Critical River Overlay Area, a minimum amount <br /> of filling may be allowed when necessary, but in no case shall the <br /> following restrictions on total amount of filling be exceeded. Since the <br /> total amount of filling which can be permitted is limited, the City, when <br /> considering permit applications, shall consider the equal apportionment <br /> of fill opportunity to riparian land owners. <br /> <br /> Total filling shall not cause the total natural flood storage capacity of the <br /> wetland to fall below the projected volume of runoff from the entire area <br /> wetland water shed generated by a ten-year storm. <br /> <br /> Total filling shall not cause the total natural nutrient stripping capacity of <br /> the wetland to fall below the nutrient production of the wetland <br /> watershed shed for its projected development. <br /> <br />51 <br /> <br /> <br />
