<br /> 9.23.01 policy and authorization. A section for the controlling of bluffland and
<br /> riverland develOpment in order to protect and preserve the outstanding scenic, recreational, natural,
<br /> historical, and s~enic values of the Rum River in Ramsey, Minnesota, in a manner consistent with
<br /> Minnesota Stattttes, §103F.301 - 103F. 345, MN Rules, pans 6105.0010 - 6105.0250, and MN
<br /> Rules, parts 6105.1400 - 6105.1500.
<br />
<br /> 9.23.02 Title. This section shall be known, cited, and referred to as the Scenic River
<br /> Section; except[as referred to herein, and where it shall be known as, "This Section".
<br />
<br />9.23.03 Scope and interpretation.
<br /> Subdivision 1. The provisions of this section shall 'apply within the designated
<br /> Scenic River _I~__d Use District of the Rum' River, in accordance wi.th the property descriptions
<br /> contained in ~ Rules, pans 6105.1400 - 6105.1500.
<br /> Subd. 2. In their interpretation and application, the provisions of this section
<br />shall be held to !be minimum requirements, and shall not be deemed a limitation' or repeal of any
<br />powers or righ~ granted by Minnesota Statutes.
<br /> · qubd. 3. It is not intended by this section to repeal, abrogate, or impair any
<br />existing easement, covenants, deed restrictions, or land use conu'ols. Where this section imposes
<br />greater restrictiqns, the provisions of this section shall prevail.
<br /> S~ubd. 4. Compliance. The use of any land within the Scenic River Land Use
<br />Disu-icc the size and shape of lots; the use and location of structures on lots; the installation and
<br />maintenance of water supply and waste disposal facilities; the filling, grading, lagooning, or
<br />dredging of any ;fiver area; the cutting of vegetation or alteration of the natural topography within
<br />the district; and he subdivision of land shall be in full compliance with the terms of this section and
<br />other applicable regulations. Penrdts from the Zoning Authority are required' by this Section, for
<br />the construction of buildings, public or private water supply and sewage treaunent systems, the
<br />grading and filll ag of the natural topography, and erection of signs within the Scenic River Land
<br />Use District of le Rum River.
<br /> · ,.,,~,,,~.~S'~3u~b~'~: 5. Definitions. For the purpose of this section, certain terms and words
<br /> defined
<br />
<br /> 4gricultural Use means the use of land for the production of food or fiber, their
<br />storage on the af~e~ a, and/or the raising thereon of domestic pets and domestic farm animals.
<br /> B, luffiine means a line along the top of a slope connecting the points at which the
<br />slope of land be~comes more than 12%. This applies to those slopes within the land use district
<br />which are beyon~I the setback provisions from the ordinary high water level.
<br /> B~uilding Line means that line measured across the width of the lot at the point
<br />where the main l, tmcture is placed in accordance with setback provisions.
<br /> {2ampground means an area accessible by vehicle and containing campsites or
<br />camping spots fc~r tents and u'ailer camping.
<br /> I31ear-cutting means the removal of an entire stand of vegetation.
<br /> (2ommissioner means the Commissioner of Natural Resources.
<br />
<br /> Qonditional Use means a use of land which is pennitted only when allowed by
<br />the Council after, a public hearing if certain conditions are met which eliminate or minimize the
<br />incompatibility xlrith the other permitted uses of the district.
<br />
<br /> I~ssentiai Services means underground or overhead gas, elecu-ical, steam or
<br />water distributic~ systems; collection, communication, supply, or disposal systems, including
<br />poles, wires, m[dns, drains, sewers, pipes, conduits, cables, fire alarm boxes, traffic signals,
<br />hydrants and otlter similar equipment and accessories in conjunction therewith; but not including
<br />buildings or tranlsmission services.
