Scenic River § 9.23 <br /> ~ubdivision means improved or unimproved land or lands which are divided for <br /> the purpose of ~ady sale or lease, or divided successively within a five year period for the purpose <br /> of sale or lease, Ih'am three or more lots or parcels of less than five acres each, contiguous in area <br /> and which are u ader common ownership or control. <br /> ,~ ubstandard Use means any use within the Land Use District existing prior to <br /> the date of enac ment of this section which is permitted within the applicable land use district but <br /> does not meet the minimum lot area, length of water frontage, structure setbacks or other <br /> dimensional s~;~dards of the section. <br /> yariance means any modification or variation of official controls where it is <br /> determined that[by reason of exceptional circumstances, the strict enforcement of the official <br /> controls would Cause unnecessary hardship. <br /> Wetland shall be as defined in Minnesota Statute. §103G.005, subd. 18. <br /> <br />9.23.04 I~istrict application. <br /> Subdivision 1. The Scenic River Land Use District of the Rum River, within <br />the City, is hereby divided into two areas, in accordance with MN Rules, parts 6105.1400 - <br />6105.1500. ~ portion of the Scenic River Land Use District located within the 2000 Urban <br />Area, Section 24, Section 25, Section 36, and the South Half of Section 13 and the West Half of <br />Section 19, Toivnship 32N, Range 25W; and the South Half of Section 19, Township 32N, <br />Range 24W, sh ~ll be classified as an Urban Area; and the remainder of the Scenic River Land Use <br />District within ~e City shall be classified as a Rural Area. <br /> ~ubd. 2. The Scenic River Land Use District shall be shown on the Official <br />Zoning Map, as !shall the urban and rural area portions of the district contained therein. <br /> ~ubd. 3. The provisions of MN Rules, parts 6105.0010 - 6105.0250, <br />6120.2500 - 61~0.3900 shall apply within the Scenic River Land Use District, as specified in the <br />Rum River Madagement Plan. Where the provisions of the City Code are in conflict with the <br />Management PI~ for the Rm River, the provisions of the Rum River Management Plan shall <br />apply. Copies/~f MN Rules, parts 6105.0010 - 6105.0250, 6120.2500 - 6120.3900, and the <br />Management Plain for the Rm River shall be kept on file in the office of the Administrator. <br /> <br />9.23.05 l~ses <br /> ~ubdivision 1.Urban Area. The Urban Area of the Scenic River Land Use <br />District is hereb~ designated the Urban Area Overlay District. <br /> a. Permitted Uses are all permitted uses allowed and regulated by the <br /> applicable zoning district underlying the Urban Area Overlay District, as <br /> indicated on the Official Zoning Map of Ramsey, Minnesota, except that <br /> public roads, utility crossings, and all private and commercial recreation <br /> uses shall be Conditional Uses. <br /> <br /> b. Conditional Uses are all conditional uses and applicable a~ached <br /> ~ conditions allowed and regulated by the applicable zoning district <br /> ; underlying the Urban Area Overlay District, as indicated on the Official <br /> Zoning Map of Ramsey, Minnesota. Conditional uses are subject to the <br /> procedures in Section 9.23.11 Subd. 6. <br /> S. ubd. 2. Rural Areas. The uses allowed within the Rural Area of the Rum <br />River Scenic Lahd Use District shall be those prescribed for a Scenic River in MN Rules, part <br />6105.0100 as follows: <br /> Scenic River <br /> 1.
