Counc~]membc~ Beycr introduced the following resolution and moved for its adoption: RESOLUTION 91-04-087 RESOLUTION DECLARING CONDITIONS OF CONDITIONAL USE PERMIT FOR AN AL~JMINUM PROCESSING PLANT ~VHE~AS, thc R,msey City Council adopted Resolution ~)1-04-086, regarding Findings of Fact for this!usc and herein approves a Conditional Usc Permit subject m thc following conditions. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSE¥, ANOKA COUNTY, STATE OF MINNESQTA, as follows: On April 23, 1~91, a conditional use permit ("CUP") .,w,,as issued by thc City of Ramscy ("City") to Aluminum R~ycling Processing, Inc. ("Permit Holder ) to operate an aluminum processing plant in thc B/W Bus,ess Warehouse District on approximately 2.58 acres of land leg'ally described as follows: Lot 2, Block 1, Gateway North Industrial Park Plat 1. Subsequent to that, the Permit Holder assigned its interest to Alloy Recovery Company. This ~ermit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this pmunit arc as f6Jlows: 1. T~rm. ~ This permit shall remain in effect so long as the conditions imposed herein are complibd with. 2. Noise,i Noises emanating from the site and operations shall be in compliance with and rcgulat~d by the State of Minnesota Pollution Control Standards, Minnesota Rules 7010.0010 to 7010.0080, as amended except as modified herein by City performance requirements. 3. Dust/Aash/Particulates. The emission of dust, ash or other particulates matter shall be in comp ',li~mce with and regulated by the State of Minnesota Pollution Control Standards, Minne$otu Rules 7005.0010 - 7005.0080, 7005.2770 subp. 2.A., and 40 CFR Pan 50 as amend ~xl except as modified herein by City performance requirements. Odor..The emission of odor from the operation shall be in compliance with and regulated by the Sm~e of Minnesota Pollutidn Control Standards, Minnesota Rules 7005.0920, as amended except ~ modified herein by City pexformance requirements. Smok~ The em~sion of smoke from the operation shall be in compliance with and regulated bY the~State of Minnesota Pollution Control standards, Minnesota Regulation 7005.0480 subp. kB., as amended except as modified herein by City performance requirements. F_wna~ Emission~ an~i Mgnit0rin~. Ern~sions from the melt furnace shall comply with State and F~e~.,eral regulations as they exist and may be modified from time to time during thc period of this [CUP. An independent 'testing laboratory shall conduct emissions monitoring.at least ' once l~r year and on a more frequent basis if pollutants are in excess of standards. The Permit)Holder shall make a complete report available to the City within thirty (30) days of completion by the testing laboratory. At a m~nimum, thc parameters of such emissions monit.(~dng shall include the following State and Federal criteria.pollutant emissions as may exist f/om ~rne to'time during the term of this permit. The cost of such testing and reports shall b~ borne by the Permit Holder.
