Councilrtiember adoption: introduced the following resolution and moved for its RESOLUTION #96-03- A RESOLUTION ADOPTING FINDINGS OF FACT # A REQIJEST FOR A CONDITIONAL USE PERMIT RELATING TO WIt. EREAS, on April 23, 1991, a conditional use permit was issued by the City of Ram.~e~, to Aluminum Recycling, Inc. (subsequently reassigned to Alloy Recovery Company~ to establish and operate an aluminum processing facility on the property generally ~mown as 7060 142nd Avenue N.W. and legally described as Lot 2, Block 1, Gateway ~North Industrial Park Plat 1; and I~I-IEREAS, on February 7, 1996, Alloy Recovery Company submitted an applicatio~ to the City of Ra~ey to enlarge the facility with a 9,000 square foot addition to the opemt!ons building. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF TH~ CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. Tliat the Applicant appeared before the Planning and Zoning Commission for a public hearing pursuant to Section 9.03.04 of the Ramsey City Code on March 4, 19[}6, and that said public hearing was properly advertised and that the minutes of sai~t.~~ public hearing are hereby incorporated by reference. 2. Tt/at the subject property is approximately 2.5 acres in size. 3. Thht the subject property is located in the Business Warehouse District. o o Th@t the adjacent parcels to the north, east and west are zoned Business Warehouse an~l the adjacent parcels to the south are zoned B-3 Highway Business. Tl~t the Applicant is proposing to enlarge the operation with a 9,000 square foot ad ,~!ition to the existing 2,100 square foot principal building. ~Th~t the Applicant has submitted a site plan drawn by John Oliver & Associates, Ino. dated February 5, 1996. Tl~,t by a physical inspection of the subject property on February 20, 1996, City Sta~-f has determined that the Applicant is not in compliance with the current cor[ditional use permit with respect to providing the City with copies of regulatory per,tilts, monitoring reports, shipping manifests, and screening outside storage. s~fin telephone conversations with Minnesota Pollution Control Agency, City has determined that for a period of time the Applicant was operating without an ~ quality permit, but is in the process of correcting that situation. That in telephone conversations with the Anoka County Environmental Services, Cit~ Staff has determined that the Applicant is operating without a Hazardous Waste Geflerators License.
