Councilrtiember <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br />RESOLUTION #96-03- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # <br />A REQIJEST FOR A CONDITIONAL USE PERMIT <br /> <br />RELATING TO <br /> <br /> WIt. EREAS, on April 23, 1991, a conditional use permit was issued by the City <br /> of Ram.~e~, to Aluminum Recycling, Inc. (subsequently reassigned to Alloy Recovery <br /> Company~ to establish and operate an aluminum processing facility on the property <br /> generally ~mown as 7060 142nd Avenue N.W. and legally described as Lot 2, Block 1, <br /> Gateway ~North Industrial Park Plat 1; and <br /> I~I-IEREAS, on February 7, 1996, Alloy Recovery Company submitted an <br />applicatio~ to the City of Ra~ey to enlarge the facility with a 9,000 square foot addition to <br />the opemt!ons building. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF TH~ CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />1. Tliat the Applicant appeared before the Planning and Zoning Commission for a <br /> public hearing pursuant to Section 9.03.04 of the Ramsey City Code on March 4, <br /> 19[}6, and that said public hearing was properly advertised and that the minutes of <br /> sai~t.~~ public hearing are hereby incorporated by reference. <br /> <br />2. Tt/at the subject property is approximately 2.5 acres in size. <br /> <br />3. Thht the subject property is located in the Business Warehouse District. <br /> <br />o <br /> <br />o <br /> <br />Th@t the adjacent parcels to the north, east and west are zoned Business Warehouse <br />an~l the adjacent parcels to the south are zoned B-3 Highway Business. <br /> <br />Tl~t the Applicant is proposing to enlarge the operation with a 9,000 square foot <br />ad ,~!ition to the existing 2,100 square foot principal building. <br /> <br />~Th~t the Applicant has submitted a site plan drawn by John Oliver & Associates, <br />Ino. dated February 5, 1996. <br /> <br />Tl~,t by a physical inspection of the subject property on February 20, 1996, City <br />Sta~-f has determined that the Applicant is not in compliance with the current <br />cor[ditional use permit with respect to providing the City with copies of regulatory <br />per,tilts, monitoring reports, shipping manifests, and screening outside storage. <br /> <br />s~fin telephone conversations with Minnesota Pollution Control Agency, City <br /> has determined that for a period of time the Applicant was operating without <br />an ~ quality permit, but is in the process of correcting that situation. <br /> <br />That in telephone conversations with the Anoka County Environmental Services, <br />Cit~ Staff has determined that the Applicant is operating without a Hazardous Waste <br />Geflerators License. <br /> <br /> <br />
