Councilmcml~r introduced the following resolution and moved for its adoption: RESOLUTION 96-03- RESOLUTION DECLARING CONDITIONS OF AMENDED CONDITIONAL USE PERMIT FOR AN ALUMINUM PROCESSING PLANT WHEIREAS, the Ramsey City Council issued a conditional use permit to Alloy Recovery Company on April 23, 1991, to establish and operate an aluminum processing plant in the Business Warehouse DI~: trict on the property generally known as 7060 142nd Avenue N.W. and legally described as I Jot 2, Block 1, Gateway North Industrial Park Plat 1; and WHEI~EAS, on February 7, 1996, the City of Ramsey received an ap. plication from Alloy Recovery Corr[pany to expand the principal structure for the aluminum processing facility by 9,000 square feet; an~ WHEI[,EAS, the Ram~y City Council adopted Resolution 4/96-03- , adopting Findings of Fact ~ ifor the enlargement of an aluminum processing facility use and herein approves the issuance of an '~imaended Conditional Use Permit for the facility subject to the following conditions. NOW THER~EFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSE¥, ANOKA COUNTY, STATE OF MINNESOTA, as follows: This permit is ~sued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this permit are as fc}llows: i . 1. Term. !Th~s permit shall remain in effect so long as the conditions imposed herein are compli~ with. 2 Noise i Noises emanating from the site and operations shall be in compliance with and regulatqd by the State of Minnesota Pollutton Control Standards, Minnesota Rules 7010.0010 to 7010!0080, as amended except as modified herein by City performance requirements.' Dust,/A~'Particulate$. The emission of dust, ash or other particulates matter shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesd~ta Rules 7005.0010 - 7005.0080, 7005.2770 subp. 2.A., and 40 CFR Part 50 as amend~ except as modified herein by City performance requirements. Odor. qtJae emission of odor from the operation shall be in compliance with and regulated by the Statet of Minnesota Pollution Control Standards, Minnesota Rules 7005.0920, as amended except a~; modified herein by City performance requirements. . Smoke. ~The emission of smoke from the operation shall be in compliance with and regulated by the ~tate of Minnesota Pollution Control standards, Minnesota Regulation 7005.0480 subp. 1.B., as amended except as modified herein by City performance requirements. Furnace iEmi~sion$ and Monitoring. Emissions from the melt furnace shall comply with State and Federal regulations as they exist and may be modified from time to time during the period of this dUP. An independent testing laboratory shall conduct emissions monitoring at least once pe~ year and on a more frequent basis ff pollutants are in excess of standards. The Permit Holder shall make a complete report available to the City within thirty (30) days of completi~)n by the testing laboratory. At a minimum, the parameters of such emissions monitoring shall include the following State and Federal criteria pollutant emissions as may
