CAS # I

REQI~EST FOR AN AMENDMENT TO CONDITIONAL USE PERMIT;
r CASE OF ALLOY RECOVERY COMPANY
By: Zoning Administrator Sylvia Frolik

Background:

Alloy Reeove~ Company established an aluminum processing facility at 7060 142.nd Avenue
N.W. by a co~difonal use permit issued by the City in 1991. Alloy has applied for a conditional
use permit to qnlarge the facility with a 9,000 square foot addition to the principal building on the
site.

Notification:

State Statute r~xluires notification to all property owners within 350 feet of the subject property.
Staff attempted, to notify all property owners north to the AEC facility, west to Ramsey Blvd.,
south to Hwy. ~10 and east to the Bury and Carlson site.

ObservationS:

The existing f~g.Mlity consists of a 2,100 square foot operations building and a 1,920 square foot
structure in wl~ch the melt furnace is housed. The applicant is proposing to increase the size of the
principal building to 11,100 square feet in order to get more of the operations into an enclosed
building.

The following items are enclosed for your information:

a)
b)
c)
d)
e)
0

~ite location map
,Site plan
Current conditional use permit
~roposed findings of fact
atOSed conditional use permit
Planning Commission public hearing and meeting minutes dated
March 4, 1996

The City Admittistmtor, City Engineer, Parks Supervisor, and Zoning Administrator visited the
site on Tuesdaf~ February 20, 1996. The Zoning Administrator has also been in communication
with the MinneSota Pollution Control Agency and the Anoka County Environmental Services. The
following deterr9~, inafions were made in response to the current conditional use permit terms:

1. Items #31 (Dust/Ash/Particulates) and Item #5 (Smoke): Staff had a telephone conversation
with Rhonda J0~anson in the Enforcement Unit of the PCA. It seems that there was not an Ak
Quality Permit ~ effect for the subject site and Alloy Recovery has made application for same.
Rhonda indicate~J that she inspected the site on September 19, 1995 and the facility appeared to be
in compliance Sd an air quality permit would most likely be issued. Alloy Recovery will be
issued what is e~ed an Option D Regulatory Permit because their emissions are very low. As
long as Alloy operates under the emission caps established in the Option D permit, they can make
changes to their! facility without filing for a new permit. Also because of their low emissions
levels, they arei not subject to annual inspections unless PCA receives coniplaints about the
operation.

2. Item g6 (Furnace Emissions and Monitoring): Alloy has not complied with the requirement
to conduct an armual emissions test and provide the City with a copy of the report.
3. Item #1~1 (Liquid Waste/Hazardous Wastes): In checking with Anoka County
Environmental Services, Staff was informed that Alloy does not have a hazardous waste generators
